Medical Device Company Must Turn Over Financial Records Post-$60M Verdict, Judge Rules

After an insulin patch pump manufacturer was awarded nearly $60 million in an intellectual property dispute, a federal judge in Massachusetts gave the go-ahead to the plaintiffs’ post-verdict discovery request for the defendants’ current financial condition.

On Tuesday, U.S. District Chief Judge F. Dennis Saylor IV of the District of Massachusetts granted Insulet Corp.’s motion for post-verdict discovery after the plaintiff company was awarded $59.4 million in a trade secrets dispute with the maker of Omnipod. Insulet, which produces the pump at issue, sued various EOFlow entities, Nephria Bio, and an executive officer, alleging they misappropriated trade secrets for the design and manufacturing of the pump. In January, Insulet moved to compel discovery for the defendants’ financial documents, which the defendants opposed as being premature and overbroad.
