At least four Big Law firms have negotiated agreements with the Trump administration to avert executive orders restricting their ability to conduct business, but one critical issue lingers—whether the agreements are enforceable.
So far, the deal terms have been posted on President Donald Trump’s social media and forwarded around internally at the four firms. Based on the publicly available terms, there is no apparent language to explain what happens if law firms do not stick to certain provisions in pro bono work and client representation. And while the four firms have agreed to hire outside counsel or an expert to make sure their employment practices are compliant with the law, the deal terms do not say what happens if the expert finds inappropriate or “illegal” conduct.
