A $43 million personal injury suit is heading for a third trial after the prevailing attorney jeopardized the verdict for a second time, an Illinois appellate court ruled this week.
On Monday, the state’s First District Appellate Court tossed the multi-million verdict in favor of Cynthia and Mark Kroft, finding the couple’s attorney made a social media post in a “deliberate effort to reach the jury” and potentially sway the outcome of the second trial in 2023. It’s the second time the Kroft’s attorney, Kenneth J. Allen, a principal at the mid-size Chicago personal injury firm, played a role in the appellate court’s rejection of the plaintiff-favorable verdicts, according to the appellate court.
