Seeing ‘Incipient Crisis,’ 4th Circuit Keeps in Place Order for Return of Wrongly Deported Man

In a scathing opinion, the U.S. Court of Appeals for the Fourth Circuit on Thursday rejected the Trump administration’s appeal of an order requiring the government to facilitate the return of a Maryland man it erroneously sent to a mega-prison in El Salvador.

Writing for a three-judge panel, Judge J. Harvie Wilkinson III said the U.S. Department of Justice’s claim that it can do nothing to facilitate Kilmar Armando Abrego Garcia’s release from custody in El Salvador should be “shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear.”
