A federal judge in North Carolina is allowing an employee’s contractual dispute to proceed against his former employee, finding new management may be liable for the previous owner’s promise to repay more than $70,000 in wages and overtime left unpaid to the worker.
U.S. District Judge William L. Osteen Jr. of the U.S. District Court for the Middle District of North Carolina issued a ruling on Sep. 13, in part denying a motion to dismiss a breach-of-contract claim against the industrial supplier, Adora Manufacturing. The case filed by a former employee, Eshan Haq, alleging he had not received his entire wages because the company “was in bad financial condition.” The case is captioned Ehsan Haq v. Adora Manufacturing.
