DC Circuit Questions Trump Administration’s Alleged CFPB Shutdown Mission

A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit on Friday heard nearly two hours of oral arguments addressing whether the Trump administration can lawfully impose mass firings and work-stoppages affecting the Consumer Financial Protection Bureau.

“I do not dispute that if there were a decision made to shut down the CFPB without legislation to that effect, that would be unlawful,” Eric D. McArthur, a deputy assistant attorney general representing the Trump administration, said at the hearing. “There is no plaintiff here who has standing to challenge the quote-unquote shutdown.”
