America First Legal was founded by Stephen Miller, who is currently the White House Deputy Chief of Staff for Policy and Homeland Security Advisor.<\/p>\n<p class=\"ql-align-center\" style=\"text-align: center;\">*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0*<\/p>\n<p>The America First Legal <a href=\"https:\/\/media.aflegal.org\/wp-content\/uploads\/2025\/02\/19171511\/DOL-Letter-Appendix.pdf\" rel=\"nofollow noopener\" target=\"_blank\">letter<\/a> states that it has \u201cidentified prohibited discrimination in over eight Federal contractors, largely based on the contractors\u2019 own public statements and representations that the implementing policies designed to alter, or \u2018balance\u2019 the race, color, sex, and national origin of its workers. These programs often involve a contractor treating employees or applicants differently based on these immutable characteristics.\u201d The letter further asserts that such practices \u201ccontradict[] Federal constitutional and statutory guarantees of individual opportunity and violate[] the equal opportunity terms of all Federal contracts,\u201d and requests that the agencies \u201cnot hesitate to enforce existing Federal regulations and [President Trump\u2019s January 21, 2025] <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/ending-illegal-discrimination-and-restoring-merit-based-opportunity\/\" rel=\"nofollow noopener\" target=\"_blank\">executive order<\/a> to ensure an immediate end to discrimination in Federal contracting.\u201d Notably, the letter cites OFCCP regulations that are based on Executive Order 11246, which President Trump rescinded in his January 21, 2025 executive order (previously discussed here).
