\n\tA federal judge rejected a lawsuit claiming the Rock & Roll Hall of Fame broke the law by using a copyrighted photo of Eddie Van Halen in a museum exhibit.<\/p>\n

\n\tDismissing a case filed by rock photographer Neil Zlozower, Judge Christopher A. Boyko said the Rock Hall made legal \u201cfair use\u201d of the image \u2014 a black-and-white photo of late-\u201970s Van Halen in the recording studio \u2014 by using it in an exhibit about famous guitars.<\/p>\n

\n\tEven though the Hall made a \u201cnearly exact\u201d copy of a portion of the photo, the judge says it did so for a very different purpose from the original: \u201cThe court concludes that defendant\u2019s use of plaintiff\u2019s copyrighted photographs is fair use,\u201d the judge wrote.<\/p>\n

\n\tZlozower filed his case last year, claiming the Hall needed a license to show the photo in the exhibit. He claimed the Cleveland institution didn\u2019t even include credit or a source for the image when it used it in the eight-foot-tall display about Eddie Van Halen\u2019s guitars.<\/p>\n

\n\tThe Rock Hall was just the latest company to face the wrath of Zlozower, a veteran rock photog who snapped pics of Led Zeppelin, The Rolling Stones and Bruce Springsteen over a decades-long career. Since 2016, court records show he\u2019s filed nearly 60 copyright cases over images of Elvis Costello, Guns N\u2019 Roses, M\u00f6tley Cr\u00fce and more.<\/p>\n

\n\tThe museum fired back in January, claiming it had made fair use of the image because it was part of a broader effort to \u201ceducate the public about the history of rock and roll music.\u201d The Rock Hall claimed it had \u201ctransformed\u201d Zlozower\u2019s original from a photo of the band into a \u201dhistorical artifact to underscore the importance of Eddie Van Halen\u2019s musical instruments.\u201d<\/p>\n

\n\tIn ruling on Monday (Nov. 10), Judge Boyko agreed with that argument. While Zlozower\u2019s original photo aimed \u201cto promote\u201d Van Halen and \u201cemphasize the band\u2019s fun-loving nature,\u201d he said the Hall\u2019s display aimed to illustrate the significance of Eddie Van Halen\u2019s guitar in \u201cthe history of rock and roll.\u201d<\/p>\n

\n\t\u201cLooking at plaintiff\u2019s photographs and defendant\u2019s exhibit side-by-side and in light of copyright law, the court finds that defendant\u2019s use adds new meaning and is transformative,\u201d the judge wrote. \u201cThis is true although the copying is nearly exact.\u201d<\/p>\n

\n\tNeither side immediately returned requests for comment on Monday.<\/p>\n
