But his lawyers say in a Monday (Oct. 6) court filing that they\u2019re not able to adequately prepare a defense without a full picture of what prosecutors are alleging.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\u201cThis indictment is impermissibly vague,\u201d writes Durk\u2019s legal team, led by veteran music industry attorney <strong>Drew Findling<\/strong>. \u201cIt leaves the defense to guess as to the government\u2019s theory of guilt, and it leaves the government free to change that theory as its cooperators\u2019 stories morph over time to meet the demands of a conviction.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">According to Durk\u2019s attorneys, a fair murder-for-hire indictment should specify precisely what bounty was offered and how exactly that offer was communicated. Far from meeting that standard, they say, Durk\u2019s indictment states merely that the rapper used \u201ccoded language\u201d to tell OTF crew members that he\u2019d reward Rondo\u2019s killers with money or \u201clucrative music opportunities.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\u201cWhat sum of money is alleged to have been offered as bounty? In cash, via a wire transfer or a written check?\u201d ask Durk\u2019s lawyers. \u201cWhat were the \u2018lucrative music opportunities\u2019 that served as the alleged consideration for the T.B.\u2019s murder? Was it a feature on one of Mr. Banks\u2019 songs that the government claims was offered and\/or furnished as consideration for the murder? If so, which song? The indictment does not state \u201cwhen, where, how and to whom\u201d Durk supposedly gave these directions \u2014 key information the defense needs to prep for trial, according to Monday\u2019s motion.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">Attorneys for Durk say these severe deficiencies require the dismissal of Durk\u2019s charges \u2014 or, at the very least, more details from prosecutors that they can use to craft a trial defense. Also on Monday, which is the deadline for pretrial motions in the case, they filed a motion challenging President Donald Trump\u2019s appointee for U.S. Attorney in L.A.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">A rep for the U.S. Attorney\u2019s Office declined to comment on the motions<em>.<\/em><\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">This is the second time Durk\u2019s lawyers have tried to have his charges thrown out since the rapper\u2019s arrest last October. Their first motion to dismiss focused on the indictment\u2019s inclusion of lyrics from Durk\u2019s song \u201cWonderful Wayne &amp; Jackie Boy,\u201d which prosecutors claimed contained references to the Rondo shooting.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">The problem, argued Durk\u2019s lawyers, was that \u201cWonderful Wayne &amp; Jackie Boy\u201d was written more than six months before the attack ever took place. Prosecutors subsequently filed a new indictment deleting the lyrics, making the original dismissal motion a moot point.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">Durk has meanwhile been awaiting trial from a jail in L.A.
