\n\tT<\/span>he gospel singer bringing a copyright infringement lawsuit against Travis Scott, SZA and Future is disputing that Ye (formerly Kanye West) was a co-writer on the demo that ultimately became the 2023 hit \u201cTelekinesis\u201d \u2014 hitting back at the trio\u2019s assertion that Ye had granted them permission to use the track.<\/p>\n

\n\tVictory Boyd made the argument in a Monday (July 28) court filing in her lawsuit over Scott\u2019s song \u201cTelekinesis,\u201d which featured SZA and Future and peaked at No. 26 on the Billboard Hot 100. The track was adapted from an unreleased Ye recording called \u201cLike the Way It Sounds,\u201d which Boyd claims she wrote for the rapper while they were collaborating on his album Jesus Is King.<\/em><\/p>\n

\n\tScott, SZA and Future argued in a motion to dismiss Boyd\u2019s claims earlier this month that they got express permission to use \u201cLike the Way It Sounds\u201d from Ye, who they say wrote the demo\u2019s chords, beat and melody.<\/p>\n

\n\tBut Boyd maintains on Monday that she\u2019s the only author of \u201cLike the Way It Sounds.\u201d The response filing argues that Scott, SZA and Future have taken \u201ccreative license\u201d with her lawsuit, which was \u201cstraightforward and succinct in asserting plaintiff\u2019s sole creation of the original work.\u201d<\/p>\n

\n\tBoyd\u2019s attorney, Keith White, <\/strong>notes that at the motion to dismiss phase of litigation, a judge must take the facts asserted in a complaint as true. If there\u2019s a question about whether Ye is a co-writer, argues White, evidence needs to be collected and analyzed to determine the truth.<\/p>\n

\n\t\u201cThe [complaint] alleges, in detail, that Boyd is the sole author of the original work and that the registrations were properly obtained,\u201d writes White. \u201cAny contrary assertions by defendants must be resolved on a developed factual record, not on a motion to dismiss.\u201d<\/p>\n

\n\tEd McPherson<\/strong>, an attorney representing Scott, SZA and Future, strongly denies that Boyd was the sole author of \u201cLike the Way It Sounds\u201d in a comment to Billboard <\/em>on Monday.<\/p>\n

\n\t\u201cWell, I\u2019m sure that will be news to Kanye, who has been receiving publishing royalties on this song since its inception!\u201d McPherson says of \u201cTelekinesis.\u201d<\/p>\n

\n\tMcPherson points to language in Boyd\u2019s own complaint, where she wrote that Ye provided her \u201cwith some chords and melodies that he liked.\u201d<\/p>\n

\n\t\u201cThat sounds to me like Kanye gave her the music,\u201d adds McPherson. \u201cIn fact, the copyright registration that she filed actually confirms that the only part of the song that she wrote was (at least some of) the \u2018lyrics!\u2019 Who is she trying to fool?!\u201d<\/p>\n
