{"id":6488,"date":"2025-06-14T01:14:57","date_gmt":"2025-06-14T01:14:57","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/8th-circuit-reinstates-untimely-discrimination-suit-against-union-pacific\/"},"modified":"2025-06-14T01:14:57","modified_gmt":"2025-06-14T01:14:57","slug":"8th-circuit-reinstates-untimely-discrimination-suit-against-union-pacific","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/8th-circuit-reinstates-untimely-discrimination-suit-against-union-pacific\/","title":{"rendered":"8th Circuit Reinstates &#8216;Untimely&#8217; Discrimination Suit Against Union Pacific"},"content":{"rendered":"\n<div data-v-1c1aa57e=\"\">\n<div data-v-1c1aa57e=\"\">\n<p>Based on a recent ruling, the U.S. Court of Appeals for the Eighth Circuit ruled this week that a plaintiff&#8217;s employment discrimination suit against Union Pacific Railroad Co. wasn&#8217;t time-barred, determining that the time limitations on the claims restarted following decertification in a similar class action.<\/p>\n<\/div>\n<p>  <!----> <!----> <!----><\/p>\n<div data-v-1c1aa57e=\"\">\n<p>On <a href=\"https:\/\/assets.alm.com\/db\/2b\/adb04b23436f92f00603da3983c0\/241211p.pdf\" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"nofollow noopener\">Thursday<\/a>, the federal appellate court reversed a U.S. District Court for the District of Nebraska decision finding the plaintiff James Hess&#8217;s suit against his former employer untimely, which he filed after he was allegedly terminated for being on anti-anxiety medication for post-traumatic stress disorder. Hess was initially part of the <i>Harris v. Union Pacific<\/i> class action, which took issue with the railroad&#8217;s &#8220;fitness for duty&#8221; requirements. The <i>Harris<\/i> class was ultimately certified, but under a different and narrower explanation that didn&#8217;t apply to Hess. In turn, Hess filed the suit, <i>Hess v.
