{"id":5755,"date":"2025-05-11T19:59:17","date_gmt":"2025-05-11T19:59:17","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/jj-renews-bid-to-remove-beasley-allen-from-talc-leadership\/"},"modified":"2025-05-11T19:59:17","modified_gmt":"2025-05-11T19:59:17","slug":"jj-renews-bid-to-remove-beasley-allen-from-talc-leadership","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/jj-renews-bid-to-remove-beasley-allen-from-talc-leadership\/","title":{"rendered":"J&#038;J Renews Bid to Remove Beasley Allen From Talc Leadership"},"content":{"rendered":"\n<div data-v-1c1aa57e=\"\">\n<div data-v-1c1aa57e=\"\">\n<p>Johnson &amp; Johnson has filed a new motion to remove Beasley Allen from leadership of the talcum powder litigation, citing \u201cserious ethical lapses.\u201d<\/p>\n<\/div>\n<p>  <!----> <!----> <!----> <!----> <!----> <!----> <!----><\/p>\n<div data-v-1c1aa57e=\"\">\n<p>Now, in an April 16 motion, Johnson &amp; Johnson wants to remove Beasley Allen from the plaintiffs\u2019 steering committee in the talc multidistrict litigation, citing an April 10 letter to Chief Legal Officer Liz Forminard and Erik Haas, vice president of worldwide litigation, in which Birchfield offered to set up a meeting to restart settlement negotiations. In a letter the next day, Forminard called Birchfield\u2019s communication with her \u201cinappropriate and unethical\u201d and accused him of \u201cethical breaches.\u201d<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-1c1aa57e=\"\">\n<p>\u201cIt is unfathomable that you would expect us to disregard such dishonest behavior and engage with you in any negotiation, having acted in such an ethically vacuous manner,\u201d she wrote in an April 11 letter to Birchfield. \u201cIn the event we were to engage in settlement negotiations with counsel on behalf of the talc claimants writ large, we would certainly not do so with you or your firm, but rather with one of the other counsel and firms that have not evidenced such lack of credibility, integrity and ethics.\u201d<\/p>\n<\/div>\n<p> <!---->  <!----> <!----><\/p>\n<div data-v-1c1aa57e=\"\">\n<p>Johnson &amp; Johnson\u2019s new motion also cited Birchfield\u2019s <a href=\"https:\/\/www.law.com\/texaslawyer\/2025\/02\/24\/this-is-an-anathema-talc-bankruptcy-testimony-spotlights-plaintiffs-bar-fractures\/\" rel=\"nofollow noopener\" target=\"_blank\"><u>testimony during a key hearing<\/u><\/a> earlier this year that focused on confirmation of its subsidiary Red River Talc\u2019s $10 billion bankruptcy plan to resolve the talc litigation. Birchfield, who represented 11,000 talc clients, falsely testified that he had the consent of his clients when voting \u201cno\u201d on their behalf, according to Johnson &amp; Johnson\u2019s motion.<\/p>\n<p label=\"Steve Brody, with O'Melveny &amp; Myers. Photo: Andrew Zinn<\/figcaption><\/figure>\n<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-1c1aa57e=\"\">\n<p>\u201cThere is simply no way that a firm that has engaged in such conduct can sit in a leadership position in this litigation,\u201d Johnson &amp; Johnson\u2019s lawyers, O\u2019Melveny &amp; Myers partner Steve Brody, in Washington, D.C., and Jessica Brennan, of Barnes &amp; Thornburg in Morristown, New Jersey, wrote. \u201cBeasley Allen has demonstrated itself unfit to represent its own clients\u2019 interests, let alone the interests of clients represented by other firms. Its continued presence on the PSC would be an intractable impediment to the fair progression of this litigation.\u201d<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-1c1aa57e=\"\">\n<p>Johnson &amp; Johnson has insisted that more than 75% of talc claimants voted in support of its bankruptcy plan. In a statement, Haas reiterated that Beasley Allen could not represent talc clients, or their own lawyers, \u201cwhose interests, loyalty, trust and confidence he has utterly and irretrievably betrayed.\u201d<\/p>\n<\/div>\n<p> <!----> <!---->  <!----><\/p>\n<div data-v-1c1aa57e=\"\">\n<p>Birchfield and Beasley Allen, in a Tuesday response, denied the allegations.<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-1c1aa57e=\"\">\n<p>\u201cJ&amp;J\u2019s effort to remove Beasley Allen from leadership is nothing more than a calculated attempt to eliminate a firm that has repeatedly worked to block its bad-faith bankruptcy schemes,\u201d wrote their lawyer, Jeffrey Pollock, of Pollock Law in Trenton, New Jersey.<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-1c1aa57e=\"\">\n<p>He wrote that Birchfield had informed his clients about the bankruptcy plan and that he would vote \u201cno\u201d if he didn\u2019t hear from them. He also noted that U.S. Bankruptcy Judge Christopher Lopez, of the Southern District of Texas, in <a href=\"https:\/\/www.law.com\/texaslawyer\/2025\/04\/01\/texas-judge-dismissed-jjs-third-talc-bankruptcy-citing-significant-voting-irregularities\/\" rel=\"nofollow noopener\" target=\"_blank\"><u>his March 31 order<\/u><\/a> dismissing the talc bankruptcy due to \u201csignificant voting and solicitation irregularities,\u201d concluded that Birchfield did not act in bad faith.<a href=\"https:\/\/www.law.com\/texaslawyer\/2025\/04\/01\/texas-judge-dismissed-jjs-third-talc-bankruptcy-citing-significant-voting-irregularities\/\" rel=\"nofollow noopener\" target=\"_blank\"> <\/a>As to the letter to Forminard, Pollock said Birchfield never discussed the merits of the litigation.<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-1c1aa57e=\"\">\n<p>\u201cIn-house counsel are not shrinking violets, they are sophisticated lawyers,\u201d Pollock wrote. \u201cThey are not going to wilt because an outside counsel or party reaches out to them.
