{"id":5683,"date":"2025-05-07T22:24:21","date_gmt":"2025-05-07T22:24:21","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/lil-durk-lawyers-demand-jail-release-after-lyrics-axed-from-indictment\/"},"modified":"2025-05-07T22:24:21","modified_gmt":"2025-05-07T22:24:21","slug":"lil-durk-lawyers-demand-jail-release-after-lyrics-axed-from-indictment","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/lil-durk-lawyers-demand-jail-release-after-lyrics-axed-from-indictment\/","title":{"rendered":"Lil Durk Lawyers Demand Jail Release After Lyrics Axed from Indictment"},"content":{"rendered":"\n<div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t<span>D<\/span>ays after federal prosecutors dropped Lil Durk\u2019s rap lyrics from his murder-for-hire case, his lawyers say the new \u201cwatered-down\u201d charges support his push to be released from jail ahead of trial.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn a court filing Tuesday (May 6), attorneys for the Chicago drill star (Durk Banks) argue that last week\u2019s superseding indictment \u2014 which removed not just Durk\u2019s lyrics but also allegations that he ordered a \u201cbounty\u201d payment \u2014 has dramatically weakened the case against him.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tBy removing those elements of the case, Durk\u2019s lawyers say the feds have \u201ceffectively conceded\u201d that they presented \u201cfalse and\/or misleading information\u201d in court \u2014 both to get the rapper charged in the first place, and to persuade the judge to deny bail.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cWith the issues of the lyrics and the payout of a \u2018bounty\u2019 altogether abandoned, what remains of the indictment is a weak patchwork of unsupported and non-specific allegations against Mr. Banks,\u201d writes defense attorney <strong>Drew Findling<\/strong>. \u201cThis watered-down new indictment, coupled with the robust bond package proposed here, tips the balance in favor of Mr. Banks\u2019 release pending trial.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tDurk was arrested in October on murder-for-hire and gun charges over allegations that he ordered members of his Only the Family (OTF) crew to carry out a 2022 attack on rival rapper Quando Rondo that left another man dead.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tTo back up that claim, the indictment cited lyrics from a song called \u201cWonderful Wayne &amp; Jackie Boy\u201d in which Durk allegedly referenced the shooting: \u201cTold me they got an addy (go, go)\/ Got location (go, go)\/ Green light (go, go, go, go, go),\u201d Durk raps in the track. \u201cLook on the news and see your son\/You screamin\u2019, \u2018No, no\u2019 (pu\u2013y).\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tBut Durk\u2019s lawyers sharply pushed back, arguing that \u201cWonderful Wayne\u201d could not have referenced the Rondo shooting for a simple reason: That the rapper wrote and recorded those verses \u201cseven months before the incident even happened.\u201d \u00a0Though prosecutors defended the inclusion of the lyrics, an updated version of the indictment released Thursday (May 1) removed them entirely.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn Tuesday\u2019s new court filing, Findling says the lyrics were a \u201chotly contested\u201d issue at a December hearing in which the judge denied to release him on bail. Now that they\u2019ve been removed entirely, he says the judge must reconsider whether Durk can be released.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThe government absolutely intended that section to illustrate direct involvement in the alleged murder-for-hire and more importantly, the knowledge of Mr. Banks of the alleged offense through some sort of musical confession,\u201d Findling says. \u201cThe government has now been proven wrong and has removed the reference, substantially depreciating the weight of the allegations.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe removal of the bounty claim presents an \u201ceven greater\u201d blow to the government\u2019s case, Durk\u2019s lawyers say, and should also help persuade the judge that bail can now be granted: \u201cWith the payment of the \u2018bounty\u2019 allegation withdrawn from the indictment, the foundation for this court\u2019s conclusions has been materially undercut.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn previous court filings, prosecutors denied that the removal of elements from the new indictment had weakened or substantially altered the case against Durk: \u201cJust like every iteration of the indictment before it, the [new indictment] contains significant allegations that show defendant\u2019s alleged role in the execution-style murder of [the victim] on a busy street corner in Los Angeles.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe judge will decide whether to reconsider Durk\u2019s bail in the weeks ahead, potentially holding a court hearing next month.
