{"id":4916,"date":"2025-03-26T03:32:26","date_gmt":"2025-03-26T03:32:26","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/diddy-wins-dismissal-of-lil-rod-rico-claims-but-sex-case-moves-on\/"},"modified":"2025-03-26T03:32:26","modified_gmt":"2025-03-26T03:32:26","slug":"diddy-wins-dismissal-of-lil-rod-rico-claims-but-sex-case-moves-on","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/diddy-wins-dismissal-of-lil-rod-rico-claims-but-sex-case-moves-on\/","title":{"rendered":"Diddy Wins Dismissal Of Lil Rod RICO Claims, But Sex Case Moves On"},"content":{"rendered":"\n<div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t<span>A<\/span> federal judge has dismissed civil racketeering accusations and other claims filed against <strong>Sean \u201cDiddy\u201d Combs<\/strong> by former collaborator <strong>Rodney \u201cLil Rod\u201d Jones<\/strong>, though he also allowed parts of the music producer\u2019s sexual abuse lawsuit to move forward.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn a decision issued Monday, <strong>Judge J. Paul Oetken<\/strong> ruled that Jones could not sue Diddy and others under the Racketeer Influenced and Corrupt Organizations Act \u2013 the federal \u201cRICO\u201d law often used against the Mafia and the same statute prosecutors are citing in their criminal case against Combs.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe judge said Jones hadn\u2019t shown that the alleged illegal \u201centerprise\u201d operated by Diddy \u2013 the kind of illicit operation outlawed by RICO \u2013 had directly caused the star to renege on paying Jones for his work Combs\u2019 <em>Love Album<\/em>.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThe court cannot identify any such causal link,\u201d Oetken wrote. \u201cDefendants\u2019 alleged sex, drug, and gun trafficking activities \u2014 the vast majority of the predicate acts pleaded in the operative complaint \u2014 did not foreseeably or naturally preclude defendants from honoring their recording contract with Jones.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tMonday\u2019s ruling dismissed the RICO charge against Combs, his chief of staff<strong> Kristina Khorram<\/strong> and his businesses. The judge also dismissed Jones\u2019 breach of contract claim and several claims emotional distress, finding them legally deficient.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tBut Oetken allowed several other key accusations to proceed, including sex trafficking, sexual assault and the claim that Combs is liable for an alleged assault perpetrated by others at his house. Those claims will now proceed into more litigation and toward an eventual trial.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tReps for the defendants and an attorney for Jones did not immediately return a request for comment. Combs has repeatedly denied all allegations of wrongdoing; Khorram <a rel=\"nofollow noopener\" href=\"https:\/\/www.cnn.com\/2025\/03\/20\/entertainment\/kristina-khorram-sean-combs\/index.html\" target=\"_blank\">denied the accusations to <em>CNN<\/em><\/a><em> <\/em>last week, saying she \u201cnever condoned or aided and abetted the sexual assault of anyone.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tJones sued Combs in March 2024, accusing the rapper of assaulting him while he was working as a producer on the <em>Love Album<\/em>. But the case went far beyond that, also leveling sweeping allegations about a vast RICO conspiracy involving numerous others, including not just Khorram but also Universal Music Group and CEO <strong>Lucian Grainge<\/strong>.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAfter UMG and Grainge said they would seek penalties over those \u201crecklessly false\u201d allegations, Jones\u2019 attorney <strong>Tyrone Blackburn<\/strong> conceded that there had been \u201cno legal basis\u201d for filing them and asked to have them \u201cwithdrawn immediately.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn Monday\u2019s decision, Oetken sharply criticized Blackburn, saying he found the lawyer\u2019s conduct in the case \u201cunsettling.\u201d He noted that court filings had been filled with \u201cinsults, misstatements, and exaggerations,\u201d and said Blackburn had leveled \u201cschoolyard taunts\u201d at opposing lawyers.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn one incident, the judge said Blackburn had referenced the criminal case before saying Combs and his companies were \u201c<em>presumed<\/em> <em>guilty<\/em> of being a RICO criminal organization\u201d \u2013 an obvious inversion of the bedrock \u201cinnocent until proven guilty\u201d standard at the heart of American criminal law.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThat any licensed member of the bar would espouse such an absurd understanding of the law is not just disturbing, but shocking,\u201d the judge wrote Monday. \u201cWhile the court will not hold Blackburn\u2019s antics against Jones at this point, it warns Blackburn that further misconduct may lead to sanctions or to referral for discipline.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tJones\u2019 lawsuit is just one of dozens filed against Combs over the past year accusing him of serious sexual abuse and other wrongdoing.
