The CEO of regional Mexican powerhouse label, Del Records, is accused of doing business with a concert promoter linked to Mexican drug cartels.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tDel Villar\u2019s ongoing trial began on March 18 at a downtown Los Angeles federal courtroom and follows a\u00a02022 criminal complaint\u00a0that charged Del Villar, among other defendants, with conspiring to violate the Foreign Narcotics Kingpin Designation Act.\u00a0Passed in 1999, the Kingpin Act allows the U.S. to impose targeted sanctions on foreign individuals involved in the illegal drug trade and ban U.S. residents from doing business with them.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn their opening statements, Del Villar\u2019s lawyers argued that the West Coast-based executive had been \u201cmanipulated\u201d by a former Del Records employee who \u201cconvinced\u201d him that what the company was doing was \u201clegally acceptable,\u201d according to reporting by <em><a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/del-records-exec-trial-narcotics-kingpin-act-gerardo-ortiz-1235298604\/\" target=\"_blank\" rel=\"noopener nofollow\">Rolling Stone<\/a><\/em>. <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThere is something deeply wrong and manipulative about how this case was created and investigated,\u201d Del Villar\u2019s defense lawyer <strong>Marissa Goldberg<\/strong> said. \u201cThe ones who actually created this crime, who manufactured it, are not sitting as defendants, which is even more deeply wrong.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tA key moment during the trial so far was when corridos star Gerardo Ortiz took the stand on March 19 to testify against Del Villar. Ortiz had already pleaded guilty to a conspiracy charge of doing business with the concert promoter, Jesus \u201cChucho\u201d P\u00e9rez Alvear, linked to the case. <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe U.S. Treasury Department\u00a0<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/home.treasury.gov\/news\/press-releases\/sm0339\">added Perez to the sanctions list<\/a>\u00a0in 2018, claiming he and his company had helped cartels \u201cexploit the Mexican music industry to launder drug proceeds and glorify their criminal activities.\u201d Ortiz \u2014 previously signed to Del Records and managed by Del Villar \u2014 testified that he had performed at Feria de San Marcos in Aguascalientes, Mexico in April 2018, promoted by P\u00e9rez Alvear, even after he had already been designated under the Kingpin Act, which is why he had also been charged in the case.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tDel Villar founded Del Records in 2008 and the label has since fueled the m\u00fasica mexicana movement. If convicted of violating the law, Del Villar would face a statutory maximum sentence of 30 years in prison. Below, a timeline of Del Villar\u2019s legal saga:<\/p>\n<div id=\"pmc-gallery-vertical\">\n<div class=\"c-gallery-vertical-loader u-gallery-app-shell-loader\">\n<ul class=\"pmc-fallback-list-items lrv-a-unstyle-list lrv-u-margin-t-2\">\n<li class=\"pmc-fallback-list-item-wrap lrv-u-margin-b-2\">\n<article class=\"pmc-fallback-list-item\">\n<h2>May 22, 2020<\/h2>\n<p>\t<!-- do not apply CSS styles to this element! --><\/p>\n<div class=\"pmc-not-a-paywall\">\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tFBI agents arrived at Del Records\u2019 headquarters in Bell Gardens, Calif., in May 2020, where a federal search warrant was executed. \u201cThe FBI executed multiple search warrants today, one of the locations was Del Records,\u201d FBI media coordinator\/spokeswoman <strong>Laura Eimiller <\/strong>said in a statement<strong>.<\/strong>\u00a0A search warrant is typically conducted early on in an ongoing investigation based on allegations of criminal activity, Eimiller added. No arrest warrants had been issued at the time.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn response to the search warrant, DEL Records said in a statement that the FBI \u201ctook a number of materials that\u00a0we understand relate to the FBI\u2019s investigation of our former artist, Gerardo Ortiz. To\u00a0the best of our knowledge, Del Records is not a subject, but merely a source of information for the FBI\u2019s investigation into Mr. Ortiz.\u00a0We have cooperated fully with the FBI and will continue to do so.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tMeanwhile, Ortiz, who signed to Del Records in 2009 and parted ways with the company in 2019 amid an ongoing contract dispute, said the following about the search warrant: <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cToday we learned the offices of Del Records and Del Entertainment Inc. were searched by the FBI, as well as the home of its owner, Jose \u00c1ngel Del Villar, pursuant to a federally issued search warrant. Gerardo Ortiz currently has a lawsuit pending before the Los Angeles Superior Court and the California Labor Commissioner against the Del companies for alleged fraudulent conduct, breach of fiduciary duty, breach of contract and violation of the Talent Agencies Act for swindling Mr. Ortiz out of many tens of millions of dollars. To our knowledge the search by the FBI at Del Records office and Mr. Del Villar\u2019s home does not involve Mr. Ortiz.\u201d<\/p>\n<\/div>\n<\/article>\n<\/li>\n<li class=\"pmc-fallback-list-item-wrap lrv-u-margin-b-2\">\n<article class=\"pmc-fallback-list-item\">\n<h2>June 14, 2022<\/h2>\n<p>\t<!-- do not apply CSS styles to this element! --><\/p>\n<div class=\"pmc-not-a-paywall\">\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tTwo years after the federal search warrant took place at the Del Records headquarters in California, Del Villar was arrested by FBI agents and was charged with \u201cconspiring to violate the Foreign Narcotics Kingpin Designation Act,\u201d according to an\u00a0<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/latin-music-company-executives-arrested-federal-complaint-alleging-violations-us\">official statement<\/a>\u00a0issued by the U.S. Attorney\u2019s Office.\u00a0<strong>Luca Scalisi<\/strong>, CFO of DEL Entertainment, was also arrested.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAccording to the U.S. Attorney, Del Villar and Scalisi were charged for \u201cconducting business with a Guadalajara-based concert promoter with ties to Mexican drug cartels.\u201d A third defendant named in the complaint is Mexican music promoter\u00a0<strong>Jesus \u201cChucho\u201d P\u00e9rez Alvear<\/strong>, who then was leading Gallistica Diamente (Ticket Premier), and until March 2019 promoted concerts in Mexico for DEL Entertainment. P\u00e9rez Alvear was killed in Mexico in 2024.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tPerez and Gallistica Diamante are listed as \u201cSpecially Designated Narcotics Traffickers\u201d under the Kingpin Act, \u201cwhich prevents people in the United States from conducting business with the two entities,\u201d according the information released by the Department of Justice.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tDel Villar and Scalisi made appearances at the United States District Court in downtown Los Angeles on June 14, where Del Villar was ordered released on $100,000 bond and Scalisi was ordered released on $35,000 bond.<\/p>\n<\/div>\n<\/article>\n<\/li>\n<li class=\"pmc-fallback-list-item-wrap lrv-u-margin-b-2\">\n<article class=\"pmc-fallback-list-item\">\n<h2>June 14, 2024<\/h2>\n<p>\t<!-- do not apply CSS styles to this element! --><\/p>\n<div class=\"pmc-not-a-paywall\">\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tDel Villar, two years after he was charged with violating a federal law that bars U.S. residents from doing business with known drug traffickers, asked a federal judge to dismiss the charges, arguing that the indictment is unfairly vague and the sign of an eventual \u201csucker punch\u201d by prosecutors. Del Villar\u2019s attorneys say the indictment failed to clearly state what aspects of that federal law he allegedly violated, leaving him unable to properly prepare a defense. Ortiz had previously pleaded guilty to a conspiracy charge of doing business with the concert promoter linked to the case,\u00a0<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/www.rollingstone.com\/music\/music-news\/del-records-exec-trial-narcotics-kingpin-act-gerardo-ortiz-1235298604\/\">according to prosecutors<\/a>.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAccording to the 2022 criminal complaint, on April 19, 2018, FBI agents approached Ortiz in Phoenix to inform him about\u00a0P\u00e9rez Alvear\u2019s\u00a0designation under the Kingpin Act. Mexican concert promoter P\u00e9rez Alvear ran a company called Gallistica Diamente (Ticket Premier) and until March 2019, promoted concerts in Mexico for DEL Entertainment.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tOrtiz told the jury he saw P\u00e9rez Alvear with Del Villar at the Del Records office in Los Angeles two or three times,\u00a0<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=nAjYj0T3ous\">according to Univision Noticias<\/a>. He added that P\u00e9rez Alvear was at the office to hire bands and artists to perform at his shows in Mexico.\u00a0Ortiz also went on to testify that he had performed at Feria de San Marcos in Aguascalientes, Mexico in April 2018, promoted by P\u00e9rez Alvear, even after he had already been designated under the Kingpin Act.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tOrtiz\u2019s attorney\u00a0<strong>Mark Werksman\u00a0<\/strong>sent\u00a0<em>Billboard\u00a0<\/em>a statement emphasizing that Ortiz did not specifically plead guilty \u201cto conspiring with or doing business with Mexican drug cartels, nor is he cooperating against the cartels.
