Casey Rodgers<\/b>, in the <b>Northern District of Florida<\/b>, now faces a judicial misconduct complaint for revealing \u201cexplicit preference for females\u201d in an order addressing leadership of the <b>Depo-Provera<\/b> multidistrict litigation.<\/p>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p><a href=\"https:\/\/www.law.com\/dailybusinessreview\/2025\/02\/28\/judicial-misconduct-complaint-accuses-depo-provera-judge-of-explicit-preference-for-females\/ \" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">Here\u2019s my story<\/a> on the Feb. 27 complaint, filed by <b>Article III Project<\/b>, which pinpointed Rodgers\u2019 language in a leadership order that \u201cfemales should be adequately represented within leadership.&#8221;<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p>Rodgers was assigned last month to oversee more than 70 lawsuits alleging Depo-Provera, an injectable birth control, was linked to brain tumors. Her leadership order reflects growing focus in the bench and bar about diversifying leadership teams in multidistrict litigation, historically dominated by white and male attorneys.<\/p>\n<\/div>\n<p> <!----> <!---->  <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p><a href=\"https:\/\/judicialstudies.duke.edu\/about\/our-team\/\" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" https:=\"\" rel=\"noopener nofollow\">Paul Grimm<\/a> (<b>Duke Law School\u2019s Bolch Judicial Institute<\/b>) and <a href=\"https:\/\/www.law.berkeley.edu\/our-faculty\/faculty-profiles\/jeremy-fogel\/#tab_profile\" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">Jeremy Fogel<\/a> (<b>UC Berkeley Law\u2019s Berkeley Judicial Institute<\/b>) <a href=\"https:\/\/www.law.com\/nationallawjournal\/2025\/03\/03\/former-judges-question-judicial-silence-amid-partisan-attacks-on-judiciary\/?kw=Former%20Judges%20Question%20Judicial%20Silence%20Amid%20Partisan%20Attacks%20on%20Judiciary&amp;utm_position=1&amp;utm_source=email&amp;utm_medium=enl&amp;utm_campaign=morningupdate&amp;utm_content=20250304&amp;utm_term=nlj&amp;oly_enc_id=0573H5136145A8T \" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">recently spoke out<\/a> about defending judges from political attacks. Here\u2019s what they had to say about the complaint against Rodgers:<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p>Grimm: <i>\u201cThe group that has filed the complaint, they have their own reasons for doing so, and own objectives they want to achieve. Whether those objectives in their complaint about what the judge did constitutes under the existing canons of judicial ethics a violation is what the committee will decide. But the underlying activity that this judge did is certainly not an outlier for purposes of establishing the criteria employed throughout the MDL community for the last 20 years or more, trying to encourage a broader base of people to seek leadership positions.\u201d<\/i><\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p>Fogel: <i>\u201cThe complaint implies that Judge Rodgers is seeking women for leadership roles without regard to their professional experience and qualifications. Courtesy photo<\/figcaption><\/figure>\n<\/p>\n<h2>Talc Bankruptcy Judge Asks \u2018What the Clients Actually Want\u2019<\/h2>\n<p>Lawyers for <b>Johnson &amp; Johnson<\/b> gave closing arguments on Feb. 28 in a two-week hearing to determine whether to dismiss the talc bankruptcy of its subsidiary, Red River Talc, and confirm a prepackaged $10 billion plan.<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p>The closings, which lasted 10 hours, <a href=\"https:\/\/www.law.com\/texaslawyer\/2025\/03\/03\/johnson--johnson-pitches-final-arguments-to-approve-10b-talc-bankruptcy-plan\/\" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">focused on several arguments <\/a>but prominently featured aspects of Johnson &amp; Johnson\u2019s July 26 vote among talc claimants for or against the plan. <b>U.S. Bankruptcy Judge Christopher Lopez<\/b>, who is overseeing the Chapter 11 case in the <b>Southern District of Texas<\/b>, asked questions about the disclosures to clients, and whether talc claimants were given enough time to consider their options. Complicating matters are nearly 12,000 clients represented by both <a href=\"https:\/\/www.beasleyallen.com\/attorney\/andy-birchfield\/\" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">Andy Birchfield <\/a>(<b>Beasley Allen<\/b>), who voted \u201cno\u201d to the plan, and <a href=\"https:\/\/smith-law.org\/about\/allen-smith\/ \" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">R. Allen Smith<\/a> (<b>Smith Law Firm<\/b>), who voted, \u201cYes.\u201d<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p>Under the plan\u2019s procedures, talc claimants could submit their vote directly, or through their attorney, but lawyers also could vote on their behalf.<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p><a href=\"https:\/\/law.utexas.edu\/faculty\/donald-rave-iii\/ \" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">D. Theodore \u201cTeddy\u201d Rave<\/a> (<b>University of Texas School of Law<\/b>), who published <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=5140220\" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">an article this year<\/a> on mass tort settlements in bankruptcies, told me the voting procedures in the talc case are common in Chapter 11 cases but do not have the same consent that is required in multidistrict litigation. He said:<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p><i>\u201cThe Beasley Allen and Smith Law Firm highlights it. When two firms can say the same group of clients vote opposite ways on the bankruptcy, we need to find out what the clients actually want, and it\u2019s not clear the process is here to get that information.\u201d<\/i><\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p label=\"James Lee of Boies Schiller Flexner. Courtesy photo<\/figcaption><\/figure>\n<\/p>\n<h2>Who Got The Work? <\/h2>\n<p><a href=\"https:\/\/www.bsfllp.com\/people\/james-lee.html\" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">James Lee<\/a> (<b>Boies Schiller<\/b>) stepped in as national counsel for <b>Lens.com<\/b> in six class actions alleging the online retailer of contact lenses tacks a processing fee at checkout, raising the total price beyond the advertised amount in violation of numerous state consumer protection laws. Last month, Lee filed a motion before the <b>U.S. Judicial Panel on Multidistrict Litigation<\/b> to coordinate the cases in Nevada, where Lens.com is based. Plaintiffs have opposed coordination, but, in a Monday reply, Lee wrote, \u201cLens.com seeks this MDL as a last resort after exhausting all possible avenues to secure plaintiffs\u2019 voluntary consolidation of these cases in Nevada.\u201d<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p>Here\u2019s what else is happening:<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p><b>Addiction Advances<\/b>: A federal judge in California issued her final dismissal order, <a href=\"https:\/\/www.law.com\/therecorder\/2025\/03\/04\/with-final-dismissal-order-social-media-addiction-claims-head-toward-trial\/ \" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">allowing most addiction claims<\/a> against social media giants such as YouTube and Instagram to go forward. The Feb. 28 order by <b>U.S. District Judge Yvonne Gonzalez Rogers<\/b>, which addressed personal injury claims of negligence, wrongful death, survival and loss of consortium, sets the stage for bellwether trials next year. Gonzalez Rogers previously allowed claims brought by school districts and state attorneys to go forward, and, for most claims, refused to immunize the social media companies from liability under Section 230 of the Communications Decency Act.<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p><b>Deflated Tires<\/b>: A federal judge in Ohio <a href=\"https:\/\/www.law.com\/nationallawjournal\/2025\/02\/28\/federal-judge-dismisses-mdl-alleging-covid-19-price-fixing-conspiracy-in-us-tire-market\/ \" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" rel=\"noopener nofollow\">dismissed multidistrict litigation<\/a> alleging a price-fixing conspiracy among tire manufacturers during the COVID-19 pandemic. <b>U.S. Chief District Judge Sara Lioi<\/b> found that the automobile dealership and other reseller plaintiffs \u201cfailed to adequately plead a conspiracy,\u201d particularly given the volatility of the pandemic on the economy. The consolidated complaint had accused companies such as <b>Bridgestone<\/b> and <b>Michelin<\/b> of raising the prices of new replacement tires by more than 20% in 2020.<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p><b>PFAS Fees<\/b>: A special master recommended which firms should get <a href=\"https:\/\/www.law.com\/2025\/02\/27\/who-got-the-1b-legal-fees-from-pfas-forever-chemical-settlements\/\" target=\"_blank\" link-data=\"{\" cms.site.owner=\"\" https:=\"\" rel=\"noopener nofollow\">more than $1 billion on common benefit fees<\/a> in the multidistrict litigation over the \u201cforever chemical\u201d PFAS in public drinking water supplies. Most of the fees are tied to two settlements: a deal with <b>3M<\/b> totaling as much as $12.5 billion, and a $1.185 billion agreement with <b>DuPont<\/b>. Last month, the special master allocated additional fees associated with a $750 million settlement with <b>Tyco<\/b> and a $316.5 million deal with <b>BASF<\/b>.<\/p>\n<\/div>\n<p> <!----> <!----> <!----> <!----><\/p>\n<div data-v-e97bc92c=\"\">\n<p><i>Thanks for reading Critical Mass!
