{"id":3436,"date":"2024-12-07T18:02:52","date_gmt":"2024-12-07T18:02:52","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/bankruptcy-homestead-spouse\/"},"modified":"2024-12-07T18:02:52","modified_gmt":"2024-12-07T18:02:52","slug":"bankruptcy-homestead-spouse","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/bankruptcy-homestead-spouse\/","title":{"rendered":"Bankruptcy \u2013 Homestead \u2013 Spouse"},"content":{"rendered":"\n<p style=\"font-size: 18px; line-height: 26px;\">U.S. Bankruptcy Court <\/p>\n<div>\n<p class=\"BODYCOPY\">Where a Chapter 13 debtor failed to identify his non-titled spouse on the debtor\u2019s homestead declaration as required by the Massachusetts homestead exemption statute, <a href=\"https:\/\/casetext.com\/statute\/general-laws-of-massachusetts\/part-ii-real-and-personal-property-and-domestic-relations\/title-i-to-real-property\/chapter-188-homesteads\/section-1881-definitions\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"color: black; text-decoration: none; text-underline: none;\">G.L.c.. 188, <\/span><\/a>\u00a75(a)(1), the Chapter 13 trustee\u2019s objection to the claimed exemption should be overruled, as the declaration complies with all the applicable requirements set forth in \u00a75(a) of the statute.\n<\/p>\n<p class=\"BODYCOPY\">\u201cBefore this Court are the Chapter 13 Trustee\u2019s Objection to Debtor\u2019s Exemptions (the \u2018Objection to Exemptions\u2019) and the Chapter 13 Trustee\u2019s Objection to Confirmation of Debtor\u2019s Chapter 13 Plan (the \u2018Objection to Plan\u2019) filed by David A. Mawhinney, the standing Chapter 13 trustee (the \u2018Trustee\u2019). At the heart of each of the objections is the Trustee\u2019s contention that the exemption in real property claimed by the debtor, Richard Dicato, Jr. (the \u2018Debtor\u2019) is invalid because the Debtor\u2019s declared homestead exemption fails to identify the Debtor\u2019s non-titled spouse. Accordingly, the Court must determine the validity of the Debtor\u2019s claimed exemption under the Massachusetts homestead exemption statute, Mass. Gen. Laws ch. 188, \u00a7\u00a7 1 <i>etseq.<\/i> (the \u2018Homestead Statute\u2019). \u2026\n<\/p>\n<p class=\"BODYCOPY\">\u201cThe Court has been unable to locate any written decision involving facts identical to those presented in this case. Therefore, in determining the validity of the Debtor\u2019s claimed homestead exemption under Massachusetts law, the Court must endeavor to predict \u2018how the Massachusetts state courts would rule if presented with the same question.\u2019 \u2026<\/p>\n<p class=\"BODYCOPY\">\u201cHere, the Debtor\u2019s Homestead Declaration is in writing, identifies the owner (the Debtor), is signed and acknowledged under penalty of perjury by the owner (the Debtor) to be benefited by the homestead, states that the Debtor occupies or intends to occupy the Property as the Debtor\u2019s residence, and was recorded in the appropriate registry of deeds. With regard <i>to the Debtor,<\/i> the declaration therefore complies with all the applicable requirements set forth in \u00a75(a) of the Homestead Statute. As in [<i>In re Zakarian<\/i>, 570 B.R. 680 (Bankr. D. Mass. 2017)], anyone inquiring of the public record would be aware that the Debtor was claiming a homestead exemption in the Property as an owner of the Property and, therefore, there is no prejudice to any creditor. Given this material compliance, lack of prejudice to any creditor, and the SJC\u2019s admonition that the Massachusetts Homestead Statute must be construed liberally in favor of debtors, the Court predicts that the Massachusetts courts would find that the Homestead Declaration is valid.\u201d\n<\/p>\n<p class=\"BODYCOPY\"><i>In Re: Dicato, Richard Jr. (Lawyers Weekly No. 04-016-24) (8 pages) (Katz, J.)
