{"id":3386,"date":"2024-11-30T17:40:16","date_gmt":"2024-11-30T17:40:16","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/diddy-denied-bail-again-in-sex-trafficking-case\/"},"modified":"2024-11-30T17:40:16","modified_gmt":"2024-11-30T17:40:16","slug":"diddy-denied-bail-again-in-sex-trafficking-case","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/diddy-denied-bail-again-in-sex-trafficking-case\/","title":{"rendered":"Diddy Denied Bail Again In Sex Trafficking Case"},"content":{"rendered":"\n<div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tA Manhattan federal judge on Wednesday (Nov. 27) again refused to release Sean \u201cDiddy\u201d Combs on bail ahead of his sex trafficking and racketeering trial next year, citing the rapper\u2019s \u201cpropensity for violence\u201d and evidence that he poses \u201ca serious risk of witness tampering.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe star\u2019s lawyers had argued he could be released on a $50 million bond and live under house arrest with \u201cnear-total\u201d restrictions, but federal prosecutors had argued that Diddy had been trying to \u201csubvert the integrity\u201d of the case from jail and would continue to do so if released.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn a ruling issued late Wednesday, Judge <strong>Arun Subramanian<\/strong> sided with the government, saying that \u201cno condition or combination of conditions will reasonably assure the safety of the community\u201d if Combs was released ahead of trial.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThere is compelling evidence of Combs\u2019s propensity for violence,\u201d the judge wrote. \u201cThere is evidence supporting a serious risk of witness tampering.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn denying bail, Judge Subramanian cited evidence that Combs had \u201cinitiated and had unexplained communication\u201d with a witness who had been called to testify before the grand jury and that he had likely already violated prison rules since he was arrested in September. The judge also cited a legal precedent that said \u201cwealthy defendants\u201d should not be released on bail to \u201cself-funded private jails.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cGiven the nature of the allegations in this case and the information provided by the government, the Court doubts the sufficiency of any conditions that place trust in Combs and individuals in his employ \u2014like a private security detail \u2014 to follow those conditions,\u201d Judge Subramanian wrote.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tA spokesperson for Combs did not immediately return a request for comment on Wednesday evening.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tCombs was indicted in September, charged with running a sprawling criminal operation aimed at satisfying his need for \u201csexual gratification.\u201d The case centers on elaborate \u201cfreak off\u201d parties in which Combs and others would allegedly ply victims with drugs and then coerce them into having sex, as well as on alleged acts of violence to keep victims silent.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tA trial is currently set to start on May 5. If convicted on all of the charges, Combs faces a potential life prison sentence.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAt a hearing in September, Judge <strong>Andrew L. Carter<\/strong> refused to release Combs on bail, saying that prosecutors had presented \u201cclear and convincing evidence\u201d that he posed a danger to the community. He said \u201cno condition or set of conditions\u201d could guard against the risk of Combs obstructing the investigation or threatening or harming witnesses.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tEarlier this month, Combs\u2019 lawyers renewed their request for bail with Judge Subramanian, who took over the case last month after Judge Carter recused himself. They again offered to pay a $50 million bond but with a \u201cfar more robust\u201d package of restrictions. They also cited the recent release of former Abercrombie &amp; Fitch CEO <strong>Mike Jeffries<\/strong> after he was arrested on similar sex trafficking charges.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThere is no legal basis for continuing to force Mr. Combs to prepare for trial from jail,\u201d his lawyers wrote in court filings.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe government fired back last week, arguing that Combs would still pose a grave risk of obstruction of justice if released. In doing so, they accused Diddy of trying to tamper with the case from behind bars, including reaching out to witnesses, leaking favorable materials, and orchestrating \u201csocial media campaigns\u201d to influence public opinion and taint the jury pool.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cDefendant has continued to engage in a relentless course of obstructive conduct designed to subvert the integrity of these proceedings,\u201d the prosecution wrote in the filing.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe decision means that until trial, Combs will remain in custody at the Metropolitan Detention Center, a federal prison in Brooklyn often used to house defendants awaiting trial.
