{"id":3270,"date":"2024-11-09T01:49:50","date_gmt":"2024-11-09T01:49:50","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/diddy-sex-abuse-case-judge-denies-request-for-gag-order-on-victims\/"},"modified":"2024-11-09T01:49:50","modified_gmt":"2024-11-09T01:49:50","slug":"diddy-sex-abuse-case-judge-denies-request-for-gag-order-on-victims","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/diddy-sex-abuse-case-judge-denies-request-for-gag-order-on-victims\/","title":{"rendered":"Diddy Sex Abuse Case Judge Denies Request for Gag Order on Victims"},"content":{"rendered":"\n<div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe federal judge overseeing Sean \u201cDiddy\u201d Combs\u2019 racketeering and sex trafficking case has denied his request for a gag order against his victims and their lawyers, ruling the demand \u201cunprecedented\u201d and \u201cunwarranted.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAttorneys for the embattled rapper claimed last month that \u201cinflammatory extrajudicial statements\u201d from victims and their attorneys were hurting his chances of a fair trial, but Judge <strong>Arun Subramanian <\/strong>ruled Friday (Nov. 8) that such \u201can extreme remedy\u201d would threaten free speech.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThe court has an affirmative constitutional duty to ensure that Combs receives a fair trial,\u201d the judge wrote. \u201cBut this essential \u2026 requirement must be balanced with the protections the First Amendment affords to those claiming to be Combs\u2019s victims.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThe unprecedented relief that Combs seeks on this motion is unwarranted,\u201d the judge added.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tCombs, also known as Puff Daddy and P. Diddy, was once one of the most powerful men in the music industry. But in September, he was indicted by federal prosecutors on charges of racketeering and sex trafficking over what they say was a sprawling criminal operation aimed at satisfying his need for \u201csexual gratification.\u201d If convicted on all the charges, he faces a potential sentence of life in prison.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tLast month, following the latest wave of civil abuse lawsuits against Combs, his lawyer asked Judge Subramanian to issue a sweeping gag order, claiming the lawyers behind the civil cases had made \u201cshockingly prejudicial and false allegations\u201d about him.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cMr. Combs has a constitutional right to a fair trial, free from the influence of prejudicial statements in the press,\u201d his attorney <strong>Marc Agnifilo<\/strong> wrote in the Oct. 20 motion. \u201cThese prospective witnesses and their lawyers have made numerous inflammatory extrajudicial statements aimed at assassinating Mr. Combs\u2019s character in the press.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tBut in Friday\u2019s decision, Judge Subramanian ruled that the order Combs was seeking was \u201cincredibly broad\u201d and would have \u201csweeping First Amendment implications.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cNot all alleged victims will be participants in this case, and a blanket restriction on their speech will silence individuals who may never have anything to do with the proceedings here,\u201d the judge wrote.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe judge said he had \u201calready taken steps to limit what can be said publicly\u201d about the case and was \u201copen to other tailored proposals that will help ensure a fair trial.\u201d He also said Combs could take specific actions in the various civil lawsuits he was facing if the lawyers in those cases misbehave. But he said he could not do anything close to what Combs was seeking.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cA gag order \u2026 is an extreme remedy to be issued only as a last resort,\u201d the judge wrote. \u201cWhat Combs seeks goes even further.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tSeparately on Friday, Combs\u2019 lawyers also renewed their request that he be released from jail on a $50 million bond while he awaits trial.
