{"id":2938,"date":"2024-10-09T14:53:00","date_gmt":"2024-10-09T14:53:00","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/diddy-appeals-bail-ruling-says-threat-to-witnesses-is-speculative\/"},"modified":"2024-10-09T14:53:00","modified_gmt":"2024-10-09T14:53:00","slug":"diddy-appeals-bail-ruling-says-threat-to-witnesses-is-speculative","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/diddy-appeals-bail-ruling-says-threat-to-witnesses-is-speculative\/","title":{"rendered":"Diddy Appeals Bail Ruling, Says Threat To Witnesses Is &#8216;Speculative&#8217;"},"content":{"rendered":"\n<div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAttorneys for <strong>Sean \u201cDiddy\u201d Combs<\/strong> filed their opening salvo in an appeal of a judge\u2019s ruling denying him bail, arguing the \u201csensationalism\u201d of the case led a judge to rule based on \u201cpurely speculative\u201d concerns about witness intimation.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn an opening brief filed late Tuesday, the rapper\u2019s lawyers urge the U.S. Court of Appeal for the Second Circuit to grant him bail \u2013 their third attempt to secure his release from a Brooklyn jail while he awaits trial on racketeering and sex trafficking charges.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tCombs\u2019 attorneys argue that a lower judge had relied on \u201cexaggerated rhetoric\u201d and \u201cspeculation\u201d when it ruled that Combs posed a flight risk and might threaten witnesses.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThe sensationalism surrounding his arrest has distorted the bail analysis,\u201d writes <strong>Alexandra A.E. Shapiro<\/strong> and <strong>Jason A. Driscoll<\/strong>. \u201cMr. Combs is presumed innocent \u2026 and presented a bail package that would plainly stop him from posing a danger to anyone or contacting any witnesses.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tCombs, also known as Puff Daddy and P. Diddy, was once one of the most powerful men in the music industry. But last month, he was indicted by federal prosecutors over accusations of sex trafficking, forced labor, kidnapping, arson and bribery. If convicted on all the charges, he potentially faces a sentence of life in prison.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tProsecutors allege that Combs ran a sprawling criminal operation aimed at satisfying his need for \u201csexual gratification.\u201d The charges detailed \u201cfreak offs\u201d in which Combs and others would allegedly ply victims with drugs and then coerce them into having sex with male sex workers, as well as alleged acts of violence and intimidation to keep victims silent.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cFor decades, Sean Combs \u2026 abused, threatened and coerced women and others around him to fulfill his sexual desires, protect his reputation and conceal his conduct,\u201d prosecutors wrote in the indictment. \u201cTo do so, Combs relied on the employees, resources and the influence of his multi-faceted business empire that he led and controlled.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tA day after the indictment was unsealed, <strong>Judge Andrew L. Carter<\/strong> denied the rapper bail. Combs\u2019 legal team offered to pay a $50 million bond and submit to strict monitoring to allow him to reside under house arrest at his Miami mansion.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tBut Carter (who has since been replaced by another judge) ruled instead that until trial Combs must remain at the Metropolitan Detention Center \u2014 a federal correctional facility long criticized for dysfunction and dangerous conditions. He was swayed by arguments from prosecutors that, if released, Combs would likely use his considerable wealth and power to obstruct the government\u2019s case by pressuring witnesses.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn Tuesday\u2019s brief, Combs\u2019 attorneys argue that there was little hard evidence to support that conclusion.
