{"id":2643,"date":"2024-09-17T16:27:27","date_gmt":"2024-09-17T16:27:27","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/judge-sides-with-kohls-striking-attempts-to-compel-arbitration\/"},"modified":"2024-09-17T16:27:27","modified_gmt":"2024-09-17T16:27:27","slug":"judge-sides-with-kohls-striking-attempts-to-compel-arbitration","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/judge-sides-with-kohls-striking-attempts-to-compel-arbitration\/","title":{"rendered":"Judge Sides With Kohl&#8217;s, Striking Attempts to Compel Arbitration"},"content":{"rendered":"\n<div>\n<p>In light of recent U.S. Court of Appeals rulings, a federal judge in Wisconsin last week denied consumer\u2019s request to compel Kohl\u2019s to submit to arbitration after the American Arbitration Association closed the files last year\u00a0because the retailer declined to pay administrative fees.<\/p>\n<p>In a\u00a0<a href=\"https:\/\/drive.google.com\/file\/d\/1SAXcnJirdlm9Gr9NiToCeAudU7_IB0ta\/view?usp=sharing\" target=\"_blank\" rel=\"noopener nofollow\">Sept. 13 opinion<\/a>, U.S. District Judge Lynn Adelman for the Eastern District of Wisconsin denied the plaintiff\u2019s motion in the case captioned\u00a0<em>Ana Bernal v. Kohl\u2019s Corp.<\/em>, in which four individuals sought an order compelling Kohl\u2019s to submit to arbitration before the American Arbitration Association under the retailer\u2019s terms and conditions. In June 2023, Kohl\u2019s refused to register the arbitration agreement or pay the associated fees, and the AAA closed the files.
