Wade <\/span><\/i><span style=\"font-weight: 400\">to <\/span><i><span style=\"font-weight: 400\">Chevron v. NRDC\u2014<\/span><\/i><span style=\"font-weight: 400\">has garnered wide public attention in recent years and thrust the justices into the political spotlight. But they have also engaged in a more subtle practice that has largely flown below the radar: narrowing, without formally overruling, precedents.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Supreme Court\u2019s June decision abandoning 40 years of <\/span><i><span style=\"font-weight: 400\">Chevron <\/span><\/i><span style=\"font-weight: 400\">deference to federal regulators was the most dramatic turn away from precedent during the October 2023 term. \u201c<\/span><i><span style=\"font-weight: 400\">Chevron <\/span><\/i><span style=\"font-weight: 400\">is overruled,\u201d declared Chief Justice John Roberts Jr. in <\/span><i><span style=\"font-weight: 400\">Loper Bright Enterprises v.
