{"id":2222,"date":"2024-08-12T22:07:41","date_gmt":"2024-08-12T22:07:41","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/6th-circuit-finds-student-has-title-ix-retaliation-case-against-university\/"},"modified":"2024-08-12T22:07:41","modified_gmt":"2024-08-12T22:07:41","slug":"6th-circuit-finds-student-has-title-ix-retaliation-case-against-university","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/6th-circuit-finds-student-has-title-ix-retaliation-case-against-university\/","title":{"rendered":"6th Circuit Finds Student Has Title IX Retaliation Case Against University"},"content":{"rendered":"\n<div>\n<p>A divided panel of the\u00a0U.S. Court of Appeals for the Sixth Circuit reinstated\u00a0a Title IX retaliation lawsuit against\u00a0the University of Kentucky, finding the district court erroneously held that the plaintiff had to be a current student at the time of a fourth disciplinary hearing\u00a0in order to proceed.<\/p>\n<p>Sixth Circuit Judge Rachel Bloomekatz wrote the 2-1\u00a0<a href=\"https:\/\/www.opn.ca6.uscourts.gov\/opinions.pdf\/24a0167p-06.pdf\" target=\"_blank\" rel=\"noopener nofollow\">majority opinion<\/a>, which reversed the\u00a0U.S. District Court for the Eastern District of Kentucky\u2019s ruling granting summary judgment\u00a0in favor of the university, which held that\u00a0\u201d\u2018none of the retaliatory items cited in the complaint\u2019 could be considered \u2018school-related actions\u2019\u201d because the plaintiff, Jane Doe, was no longer enrolled at a community college during which the alleged retaliatory actions occurred.
