But how many lawsuits has he actually faced? <em>Billboard <\/em>decided to find out.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tJust hours after Ye\u2019s brand new <em>Vultures 2 <\/em>dropped on Saturday, he was already facing claims that the new album featured uncleared music. In <a rel=\"nofollow noopener\" href=\"https:\/\/x.com\/jetfury\/status\/1819786165370622143\" target=\"_blank\">a social media post<\/a>, electronic music artist Geoff Barrow shared a clip of Ye\u2019s song \u201cField Trip\u201d above the words \u201cnot again\u201d \u2013 seemingly an accusation that the track featured a sample from the song \u201cMachine Gun\u201d by Barrow\u2019s band Portishead.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIt\u2019s currently unclear whether Barrow or anyone else will take legal action against Ye over the new song. But if he did, he would hardly be the first to do so.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tOver the course of his career, federal court records show that the rapper has been sued at least 14 times over claims of unlicensed sampling (the use of a copyrighted <em>sound recording<\/em>) or interpolating (the use of a copyrighted <em>composition<\/em>) in his songs, with nine of those cases coming since 2019 alone. And that\u2019s not counting cases where others have been sued over his songs, like a case filed in 2012 against Roc-A-Fella Records, or a recent case against UMG filed by members of prog rock band King Crimson, nor allegations that didn\u2019t result in a lawsuit, like Ozzy Osbourne\u2019s accusations earlier this year.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tTo keep it all straight, <em>Billboard <\/em>dug up the court records from every case against Ye. Johnson claimed he had explicitly refused to clear the same sample when Kanye tried to release the same song on his own earlier album: \u201cDefendants\u2019 infringing acts were and continue to be committed willfully.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t<strong>How it ended: <\/strong>West and Jay-Z denied the accusations \u2013 and even questioned what rights Johnson owned to a song released before federal sound recording copyrights were created in 1972. The case claimed that Kanye had illegally sampled from \u201cBumpin\u2019 Bus Stop,\u201d a 1974 song released by Pryor\u2019s group Thunder And Lightning. Pryor\u2019s family called West\u2019s use of the clip an \u201cunabashed theft of plaintiffs\u2019 intellectual property.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t<strong>How it ended: <\/strong>Facing a case over his biggest commercial hit, Kanye fought back. He eventually won a ruling in 2014 dismissing the case on the grounds that the samples were \u201cde minimis\u201d \u2013 meaning so short that they didn\u2019t count as copyright infringement. Kanye West<\/h2>\n<p>\t<!-- do not apply CSS styles to this element! --><\/p>\n<div class=\"pmc-not-a-paywall\">\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t<strong>May 2016<\/strong><\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t<strong>The accusation:<\/strong> Gabor Presser, a former member of a Hungarian rock band called Omega, accused West in his lawsuit of sampling a 1969 song \u201cGyongyhaju Lany\u201d in his 2013 track \u201cNew Slaves.\u201d And Kanye\u2019s lawyers later admitted it, chalking it up to the final clearance paperwork \u201cfalling between the cracks.\u201d The case got heated in early 2017, when West\u2019s lawyers blasted the plaintiff\u2019s attorneys for attempting to force the superstar to travel cross-country for an in-person deposition: \u201cMr. West is a celebrity. Kanye apparently sought approval from Green\u2019s birth mother rather than her legal guardians \u2013 though he allegedly never actually paid her, either.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t<strong>How it ended:<\/strong> West settled the case in 2021 with a rare, publicly-disclosed agreement. The company claimed that West\u2019s people reached out to clear the use of the Boogie Down song, but that the star had released his track even though a deal was never struck.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t<strong>How it ended: <\/strong>Ye fought back, asking a judge to dismiss the case with an unusual argument: That Boogie Down founder KRS-One had publicly promised all future rappers that \u201cyou will not get sued\u201d if you sample the group\u2019s music. The plaintiffs later called that a \u201cbizarre argument,\u201d noting that KRS-One didn\u2019t actually own the music he was claiming to place in the public domain. The estate claimed that it had expressly rejected his request to use her song because it wanted \u201cno association\u201d with the controversial rapper: \u201cThis lawsuit is about \u2026 the rights of artists to decide how their works are used and presented to the public, and the need to prevent anyone from simply stealing creative works when they cannot secure the right to use them legally.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t<strong>How it ended: <\/strong>Ye and the estate finalized a settlement in June, but unlike many other such agreements, the deal did <em>not <\/em>give Ye retroactive approval for his track: \u201cWe did not license the song,\u201d the estate\u2019s attorney told <em>Billboard<\/em> at the time. \u201cAs part of the settlement, they have agreed not to distribute or otherwise use the song.
