{"id":1427,"date":"2024-06-20T16:51:14","date_gmt":"2024-06-20T16:51:14","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/madonna-lawsuit-over-concert-delays-dropped-by-accusers\/"},"modified":"2024-06-20T16:51:14","modified_gmt":"2024-06-20T16:51:14","slug":"madonna-lawsuit-over-concert-delays-dropped-by-accusers","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/madonna-lawsuit-over-concert-delays-dropped-by-accusers\/","title":{"rendered":"Madonna Lawsuit Over Concert Delays Dropped By Accusers"},"content":{"rendered":"\n<div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tTwo <a href=\"https:\/\/billboard.com\/artist\/madonna\" rel=\"nofollow noopener\" target=\"_blank\">Madonna<\/a> fans have now dropped their lawsuit complaining about delayed starts to her concerts, but the star\u2019s lawyers are emphatic that the move was \u201cnot the result of any settlement\u201d and are warning they might even seek penalties over the \u201cfrivolous\u201d case.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn a motion filed in federal court Wednesday, lawyers for the aggrieved fans said they would permanently drop the case, in which they accused Madonna and Live Nation of breaking laws by making fans wait for hours at December concerts in Brooklyn on her Celebration Tour.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tBut later that same day, Madonna and Live Nation\u2019s lawyers fired off a letter to the judge advising him that the move to drop the case had been made \u201cunilaterally\u201d by the other side \u2014 and that they had <em>not<\/em> reached any kind of agreement to end a case they say should never have been filed.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cDefendants believe that this action was a frivolous strike suit designed to force them to incur legal expenses,\u201d the star\u2019s lawyers write. \u201cPlaintiffs have now abandoned this lawsuit when it became clear that this approach would not result in a settlement payment and that they would need to oppose defendants\u2019 motion.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe motion to dop the case said that each side would \u201cbear its own fees and costs,\u201d but Madonna\u2019s lawyers said in their letter that they had never agreed to that \u2013 and that they might still demand that the plaintiffs repay the money they were forced to spend litigating the short-lived lawsuit.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cGiven the legal expenses that defendants were forced to incur to defend this action \u2026 defendants reserve the right to move for sanctions, attorneys\u2019 fees, and costs,\u201d lawyers for Madonna and Live Nation write.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAn attorney for the plaintiffs, <strong>Michael Fellows<\/strong> and <strong>Jason Alvarez<\/strong>, did not immediately return a request for comment on Thursday.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tMadonna and Live Nation were first sued in January over the Brooklyn shows \u2014 a case that made headlines because it claimed the fans \u201chad to get up early to go to work\u201d the next day. She was later hit with a similar case in Washington, D.C. that claimed fans had waited in an \u201cuncomfortably hot\u201d arena and that she had lip-synched portions of the show. A third case, filed last month, echoed those claims but also alleged that Madonna\u2019s show in Los Angeles had been unexpectedly \u201cpornographic.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAll three cases have been filed as class actions, seeking to represent potentially thousands of other fans who also faced the alleged delays. By starting the concerts later than expected, the cases claim Madonna and Live Nation breached their contracts with fans and violated state consumer protection laws.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tMadonna\u2019s attorneys have strongly rejected those accusations. In a request to dismiss the New York case earlier this year, her lawyers argued that simply needing to wake up early was not the kind of \u201ccognizable injury\u201d that can form the basis for a lawsuit.
