{"id":1310,"date":"2024-06-12T14:56:32","date_gmt":"2024-06-12T14:56:32","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/sony-label-sued-over-dj-regards-remix-of-jay-seans-ride-it\/"},"modified":"2024-06-12T14:56:32","modified_gmt":"2024-06-12T14:56:32","slug":"sony-label-sued-over-dj-regards-remix-of-jay-seans-ride-it","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/sony-label-sued-over-dj-regards-remix-of-jay-seans-ride-it\/","title":{"rendered":"Sony Label Sued Over DJ Regard&#8217;s Remix of Jay Sean&#8217;s &#8216;Ride It&#8217;"},"content":{"rendered":"\n<div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tLONDON \u2014 A U.K. indie label is suing Sony Music-owned Ministry of Sound Recordings over a remix of a song by R&amp;B artist Jay Sean that became a global viral hit on TikTok a decade after its original release.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAccording to legal papers filed in the London High Court, which have been viewed by <em>Billboard<\/em>, 2Point9 Records is suing Ministry of Sound for copyright infringement of Sean\u2019s \u201cRide It\u201d \u2013 a Top 20 single in the United Kingdom in 2008.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAttorneys for London-based 2Point9 say that a 2019 remix of \u201cRide It\u201d by Kosovo-based producer DJ Regard, whose real name is <strong>Dardan Aliu<\/strong>, illegally sampled the master recording of Sean\u2019s original track without clearing its use.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tFirst posted on TikTok, Regard\u2019s \u201cRide It\u201d quickly became a viral hit before being licensed by Sony-owned imprint Ministry of Sound Recordings and officially released in July 2019.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe track peaked at number two in the U.K. singles chart the same year. In the U.S., Regard\u2019s \u201cRide It\u201d peaked at number 62 on the Hot 100 (where it spent 10 weeks on the chart) and number three on the Billboard Top 100 Hot Dance\/Electronic chart.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe song has since gone on to be streamed more than 1.3 billion times on Spotify, while the video has been viewed more than 285 million times on Regard\u2019s official YouTube channel. 2Point9 says total YouTube views of the remix have crossed 500 million and well over 4 million videos have been created by TikTok users.<\/p>\n<div class=\"post-content-image \/\/  \">\n<figure class=\"o-figure   alignright size-medium alignright lrv-u-max-width-100p\" style=\"width:100%; max-width:300px;\">\n<div class=\"c-lazy-image  \">\n<div class=\"lrv-a-crop-16x9\" style=\"padding-bottom:calc((198\/300)*100%);\">\n<p>\t\t\t\t\t\t<\/p><\/div>\n<\/p><\/div><figcaption class=\"c-figcaption  lrv-u-flex lrv-u-flex-direction-column a-font-primary-xs lrv-u-color-black lrv-u-margin-t-050 lrv-u-padding-lr-125@mobile-max lrv-u-border-b-1 lrv-u-border-color-grey-light lrv-u-padding-b-1\">\n<p>\t\t\t\t\t<span class=\"\"><em>DJ Regard<\/em><\/span><\/p>\n<p>\t\t\t\t\t\t\t\t\t<cite class=\"lrv-u-color-grey\">Courtesy Photo<\/cite><\/p>\n<\/figcaption><\/figure>\n<\/div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe London-based indie, which was founded by <strong>Billy Grant<\/strong> and <strong>Rob Stuart<\/strong> in 2000, alleges that Ministry of Sound Recordings was notified that the track featured an unauthorized sample of Jay Sean\u2019s 2008 song when it first released it, but \u201cchose not to enter into any meaningful commercial discussions\u201d over clearing the sample.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t2Point9\u2019s legal claim is for infringement of the production master recording rights of the original version of \u201cRide It,\u201d which the label says it owns on a worldwide basis.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe indie label employed producer Alan Sampson in 2007 to work with Jay Sean, real name <strong>Kamaljit Singh Jhooti<\/strong>, on a number of songs, including \u201cRide It.\u201d Sampson is not listed among the claimants and Billboard understands that the producer assigned his share of the master recording rights to 2Point9 under the terms of his 2007 production contract.\u00a0\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAttorneys for 2Point9 say that when Ministry of Sound was first told in 2019 that the DJ Regard version of \u201cRide It\u201d featured an unauthorized sample, the Sony-owned label rejected their claims and insisted the new song featured a re-recording of Sean\u2019s vocal.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tSeveral months later, Ministry of Sound acknowledged that Regard\u2019s song did feature parts of the original recording and subsequently replaced the infringing sample with a re-recorded version.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe re-recorded \u201cRide It\u201d was commercially released in late 2019 but was assigned the same <a href=\"https:\/\/usisrc.org\/about\/index.html\" data-type=\"link\" data-id=\"https:\/\/usisrc.org\/about\/index.html\" rel=\"nofollow noopener\" target=\"_blank\">ISRC code<\/a> as the earlier infringing song, say 2Point9. The indie label infers this was done to prevent any distinction being drawn between the two songs when tracking global plays. The original DJ Regard track (featuring the unauthorized sample) still continued to receive regular airplay in the U.K. after the new version was released, claim 2Point9.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThroughout the entire time we have been pursuing this claim, Ministry of Sound Recordings has treated our label with arrogance and dismissiveness,\u201d said <strong>Billy Grant<\/strong>, co-founder of 2Point9 Records, in a statement.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cWhy they think that this kind of behaviour against a small label is acceptable is bewildering,\u201d said Grant, noting that prior to Ministry of Sound\u2019s acquisition by Sony Music Entertainment in 2016 it too was an independent label.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tGrant vowed to continue his legal fight \u201cuntil we get justice\u201d and said his company was \u201cdetermined\u201d to make Ministry of Sound realize \u201cthat it is not OK to ride roughshod over the commercial rights of those in the independent sector and that there are consequences for doing so.\u201d\u00a0\u00a0\u00a0\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAccording to legal papers, 2Point9 Records has not yet been able to fully quantify the size of its losses and damages relating to the infringing recording but believes them to be substantial.
