{"id":1218,"date":"2024-06-10T16:18:50","date_gmt":"2024-06-10T16:18:50","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/madonnas-lawyers-say-no-settlement-reached-in-concert-delay-lawsuit\/"},"modified":"2024-06-10T17:36:53","modified_gmt":"2024-06-10T17:36:53","slug":"madonnas-lawyers-say-no-settlement-reached-in-concert-delay-lawsuit","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/madonnas-lawyers-say-no-settlement-reached-in-concert-delay-lawsuit\/","title":{"rendered":"Madonna&#8217;s Lawyers Say No Settlement Reached In Concert Delay Lawsuit"},"content":{"rendered":"\n<div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAttorneys for Madonna and Live Nation say they\u2019re facing a \u201charassment campaign\u201d from the lawyers suing over delayed starts to the singer\u2019s concerts, aimed at \u201cextorting a lucrative settlement\u201d rather than actually litigating the case.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe charged language came amid a class action accusing Madonna and Live Nation of breaking laws by making fans wait hours at December concerts in Brooklyn on her Celebration Tour \u2014 one of three such cases filed over the past six months that all make similar allegations.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tOver the weekend, the dueling teams of lawyers engaged in a bizarre back and forth. On Friday (June 7), attorneys for the accusers told the judge that the two sides had \u201creached a settlement\u201d that would end the case. But first thing on Monday morning (June 10), Madonna\u2019s legal team emphatically denied that any such deal had been reached: \u201cThe parties have not settled this matter.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cTo be clear, defendants are not necessarily opposed to settlement if certain terms can be reached,\u201d wrote <strong>Jeff Warshafsky<\/strong>, a partner at the law firm Proskauer who reps Madonna and Live Nation. \u201cBut defendants will not be harassed into settlement and cannot abide false statements made to the court.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn the filing, Madonna\u2019s lawyer said the two sides had \u201cdiscussed the possibility of settlement\u201d but that they had \u201cmade no settlement offer\u201d and\u00a0\u201cwe do not know what plaintiffs believe they are accomplishing or trying to accomplish with the false notice.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThe false notice is part and parcel of the harassment campaign that plaintiffs\u2019 counsel has been waging against defendants over the last several months in hopes of extorting a lucrative settlement by forcing defendants to incur unnecessary legal fees,\u201d Warshafsky wrote. \u201cWhatever plaintiffs\u2019 motive \u2026 defendants believe plaintiffs\u2019 complaint is completely without merit and intend to fully defend themselves.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAn attorney for Madonna\u2019s accusers did not immediately return a request for comment.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tMadonna and Live Nation were first sued in January over the Brooklyn shows \u2014 a case that made headlines because it claimed the fans \u201chad to get up early to go to work\u201d the next day. She was later hit with a similar case in Washington, D.C. that claimed fans had waited in an \u201cuncomfortably hot\u201d arena and that she had lip-synched portions of the show. A third case, filed last month, echoed those claims but also alleged that Madonna\u2019s show had been unexpectedly \u201cpornographic.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAll three cases have been filed as class actions, seeking to represent potentially thousands of other fans who also faced the alleged delays. By starting the concerts later than expected, the cases claim Madonna and Live Nation breached their contracts with fans and violated state consumer protection laws.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tMadonna\u2019s attorneys have strongly rejected those accusations. In a request to dismiss the New York case earlier this year, her lawyers argued that simply needing to wake up early was not the kind of \u201ccognizable injury\u201d that can form the basis for a lawsuit. And they say that anyone buying a concert ticket is well aware that a show likely won\u2019t start at the exact time printed on the ticket.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cNo reasonable concertgoer \u2014 and certainly no Madonna fan \u2014 would expect the headline act at a major arena concert to take the stage at the ticketed event time,\u201d her legal team wrote in April.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tA version of that motion to dismiss the case remains pending.
