\n\tA Venezuelan composer claims in a new lawsuit that he\u2019s owed more than $300,000 in royalties from two Willie Col\u00f3n songs he penned for the late salsa legend.<\/p>\n

\n\tThe legal complaint, filed by singer-songwriter Am\u00edlcar Bosc\u00e1n on Monday (July 20) and first obtained and reported by Billboard<\/em>, focuses on the Col\u00f3n songs \u201cCaer en Gracia\u201d and \u201cTalento de Televisi\u00f3n.\u201d Bosc\u00e1n wrote both these tracks for Tras La Tormenta<\/em>, Col\u00f3n\u2019s 1995 collaborative album with Rub\u00e9n Blades that hit No. 3 on Billboard<\/em>\u2018s Top Tropical Albums chart.<\/p>\n

\n\tBosc\u00e1n is suing the Willie Col\u00f3n Music Company, which according to the lawsuit was owned and controlled by Col\u00f3n until his death earlier this year. Bosc\u00e1n alleges he signed over his Tras La Tormenta<\/em> copyrights to this company in 1994 and was promised 50% of all publishing royalties.<\/p>\n

\n\t\u201cHowever, defendant never paid plaintiff the vast majority of the royalties owed under the songwriter agreement, and defendant never sent plaintiff the royalty statements as required by the songwriter agreement,\u201d reads the lawsuit.<\/p>\n

\n\tBosc\u00e1n believes he\u2019s owed more than $300,000 in royalties for the two songs, noting in the lawsuit that \u201cTalento de Televisi\u00f3n\u201d has more than 450 million streams to date on Spotify alone. He claims that Willie Col\u00f3n Music Company left his name off BMI registration paperwork, \u201cfalsely representing Col\u00f3n to be the composer of \u2018Talento de Televisi\u00f3n.\u2019\u201d<\/p>\n

\n\tIn technical terms, Bosc\u00e1n is leveling claims for breach of contract and violations of the Digital Millennium Copyright Act. The composer is also asking a judge to declare that his rights to both \u201cCaer en Gracia\u201d and \u201cTalento de Televisi\u00f3n\u201d will soon revert back to him under copyright law\u2019s termination right. The termination right allows an author to claw back copyrights decades after signing them away. Bosc\u00e1n says he sent a notice of termination to Willie Col\u00f3n Music Company two years ago with an effective date of 2031, but that the publisher \u201chas disputed the validity\u201d of the notice and \u201chas further disputed whether termination of the songwriter agreement would ever be permitted.\u201d<\/p>\n

\n\tA rep for Col\u00f3n\u2019s estate did not immediately return a request for comment on the lawsuit on Tuesday (July 21).<\/p>\n

\n\tCol\u00f3n, the Bronx-born trombonist and bandleader who\u2019s known as one of the architects of salsa, died in February at the age of 75. He recorded a number of songs throughout the years that were composed by Bosc\u00e1n, who got his start as lead singer of the Venezuelan band Guaco and has also had a solo singing career of his own.<\/p>\n
