{"id":11060,"date":"2026-06-28T01:11:03","date_gmt":"2026-06-28T01:11:03","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/browning-ferris-joint-employer-standard-revived-sullivan-cromwell-llp\/"},"modified":"2026-06-28T01:11:03","modified_gmt":"2026-06-28T01:11:03","slug":"browning-ferris-joint-employer-standard-revived-sullivan-cromwell-llp","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/browning-ferris-joint-employer-standard-revived-sullivan-cromwell-llp\/","title":{"rendered":"Browning-Ferris Joint-Employer Standard Revived | Sullivan &#038; Cromwell LLP"},"content":{"rendered":"\n<div id=\"contentSummaryCollapse\" style=\"--intro-p-height: 10.3125rem;\">\n<div class=\"inner-collapse\">\n<p>On February 26, the NLRB <a href=\"https:\/\/apps.nlrb.gov\/link\/document.aspx\/09031d45826ffc1d\" target=\"_blank\" rel=\"nofollow noopener\">vacated its recent decision<\/a> in <em>Hy-Brand Industrial Contractors, Ltd. and Brandt Construction Co.<\/em>, 365 NLRB No. 156 (Dec. 14, 2017), because of Board Member William Emanuel\u2019s participation in the decision.\u00a0The NLRB Inspector General concluded that Emanuel should not have cast a vote in the decision because his former law firm had represented one of the unsuccessful litigants in <em>Browning-Ferris Industries<\/em>, 362 NLRB No. 186 (2015), the decision that <em>Hy-Brand <\/em>overturned.
