{"id":11038,"date":"2026-06-25T08:53:59","date_gmt":"2026-06-25T08:53:59","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/new-york-state-senate-passes-bill-banning-mandatory-arbitration-for-sexual-harassment-claims\/"},"modified":"2026-06-25T08:53:59","modified_gmt":"2026-06-25T08:53:59","slug":"new-york-state-senate-passes-bill-banning-mandatory-arbitration-for-sexual-harassment-claims","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/new-york-state-senate-passes-bill-banning-mandatory-arbitration-for-sexual-harassment-claims\/","title":{"rendered":"New York State Senate Passes Bill Banning Mandatory Arbitration for Sexual Harassment Claims"},"content":{"rendered":"\n<div id=\"contentSummaryCollapse\" style=\"--intro-p-height: 10.3125rem;\">\n<div class=\"inner-collapse\">\n                        On March 12, 2018, the New York State Senate passed <a href=\"http:\/\/legislation.nysenate.gov\/pdf\/bills\/2017\/S7848A\" target=\"_blank\" rel=\"nofollow noopener\">Senate Bill No. 7848A <\/a>by a vote of 56 to 2, which, among other things, would: 1) ban contractual provisions that mandate arbitration of sexual harassment claims; 2) require court approval of sexual harassment settlement agreements with confidentiality provisions, and provide that such provisions are not permitted unless it is the claimant\u2019s \u201cpreference\u201d that the agreement be confidential; 3) adopt a uniform definition of \u201csexual harassment\u201d in the State employment statutes; and 4) extend employer liability for sexual harassment to independent contractors and other non-employees in an employer\u2019s workplace. The Bill also requires all state contractors to adopt anti-sexual harassment policies and training programs. Finally, the Bill tasks the Department of Labor to create a model policy related to sexual harassment.<\/p>\n<p>Governor Cuomo has made <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-cuomo-details-legislation-empower-employees-seeking-justice-sexual-harassment\" target=\"_blank\" rel=\"nofollow noopener\">similar proposals <\/a>as part of his proposed budget, but his proposed legislation is more sweeping than Senate Bill No. 7848A. Among other things, Governor Cuomo\u2019s bill proposes banning mandatory arbitration clauses in all employment agreements.<\/p>\n<p>The Senate Bill and Governor Cuomo\u2019s proposed budget will now be considered by the New York State Assembly.
