But at a court hearing Thursday (June 12), that argument got a chilly reception from a panel of five appellate judges, who sharply noted there was \u201cno indication\u201d that Tompkins had ever even seen the lawsuit.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cSo counsel, you\u2019re asking for a default judgment for four months\u2019 delay, where it doesn\u2019t even appear that the defendant was served properly. You can\u2019t believe everything that\u2019s on the internet about all our addresses.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tReisberg did not immediately return a request for comment from him or his client.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t50 Cent\u2019s publishing company, G-Unit Books, sued last year after Tompkins, the mother of his child, Marquise Jackson, went viral with a series of Instagram posts commenting on the criminal trial of Sean \u201cDiddy\u201d Combs. If given the chance to fully rebut 50 Cent\u2019s accusations, she said she would be able to easily do so because the contract she signed had clearly been invalid.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThe agreement was presented as a take-it-or-leave-it ultimatum, and I was given no opportunity to seek independent counsel or negotiate any terms,\u201d Tompkins wrote in an affidavit at the time. \u201cFearing for my life and for my children\u2019s lives, I signed the agreement under extreme duress.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tBut owing to Tompkins\u2019 delayed response, 50 Cent\u2019s lawyers asked the judge for a default judgment, saying she had missed her shot to fight the case with such a response. The judge ultimately denied that request, prompting the rapper\u2019s lawyer to file the appeal to the appellate court.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tFollowing Thursday\u2019s hearing, that appeal appears unlikely to succeed. After suggesting that Reisberg had \u201cessentially\u201d admitted that Tompkins wasn\u2019t properly served, the judges then hammered him on whether his client had suffered any real prejudice \u2014 meaning, whether the delay had caused any problems for 50\u2019s lawsuit.
