Wednesday\u2019s court filing, obtained by <em>Billboard<\/em>, argues that Flagg \u201cembraced and sought to associate herself\u201d with <em>The Life of a Showgirl<\/em> to get a \u201cmarketing boost.\u201d They cite more than 40 posts on Flagg\u2019s Instagram and TikTok pages that feature Swift\u2019s music, plus hashtags like #thelifeofashowgirl, #TS12, #taylorswift and #swifties.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cFar from showing any concern about the album after its announcement, Ms. Flagg spent several months centering her brand on <em>The Life of a Showgirl<\/em>\u2019s name, artwork, music and lyrics to promote her little-known cabaret show,\u201d reads the filing. \u201cWhen plaintiff\u2019s attempts to exploit Ms. Swift\u2019s intellectual property failed to garner the desired attention (likely because, despite Ms. Flagg\u2019s best efforts, consumers were not confused into believing these two brands were even remotely connected), she concocted a meritless lawsuit.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tSwift\u2019s attorneys say Flagg is <em>actually<\/em> the one here who has committed infringement by misusing the star\u2019s intellectual property, and they \u201cwill be pursuing appropriate remedies for that intentional, commercial misuse.\u201d This echoes the strategy Swift\u2019s team employed when Utah\u2019s Evermore Park filed a trademark lawsuit in 2021 over her album <em>Evermore<\/em>, and she countersued the theme park for playing her music without proper licenses. Both cases were ultimately dropped with no money exchanged.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tWednesday\u2019s response papers argue that a judge should reject Flagg\u2019s injunction motion because <em>The Life of a Showgirl <\/em>merch is tied to Swift\u2019s First Amendment-protected expression, citing Lady Gaga\u2019s victory over a similar request to stop sales of her <em>Mayhem<\/em> album merch amid a trademark lawsuit late last year. Even without artistic expression protections, Swift\u2019s lawyers say the motion fails because there\u2019s no chance of customers mistaking \u201cConfessions of a Showgirl\u201d for <em>The Life of a Showgirl<\/em>.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cIt is widely known that Ms. Swift\u2019s fanbase is a dedicated and informed set of consumers,\u201d reads the filing. \u201cTheir attention to detail is legendary when it comes to information about Ms. Swift\u2019s albums or merchandise, with fans eagerly detecting \u2018easter eggs\u2019 and pouring over Ms. Swift\u2019s works in connection with numerology codes and word searches. There is no chance they would be confused between plaintiff\u2019s cabaret shows and Ms. Swift\u2019s album and related promotional merchandise.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tSwift\u2019s lawyers also spend some time in the court papers attacking the purported similarities between the two trademarks, noting that they have different dominant terms, fonts, color schemes, spacing and meanings. And they say that while both marks cover live entertainment, it\u2019s \u201cabsurd\u201d to compare the \u201cConfessions of a Showgirl\u201d act to something like The Eras Tour: \u201c\u2018[Swift\u2019s] performances are musical concerts at sold-out stadiums with thousands of attendees, not at golf resorts or cabaret-style venues.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tBecause of all this, Swift\u2019s lawyers say they will win in the long run at registering a trademark for <em>The Life of a Showgirl<\/em>, even though the U.S. Patent and Trademark Office initially rejected their application due to a likelihood of confusion with Flagg\u2019s prior mark. They say the process remains ongoing, emphasizing that this prior \u201cnonfinal office action is exactly what it sounds like, not final (and not uncommon).\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tFlagg\u2019s lawyers will now get a chance to rebut Swift\u2019s arguments in another court filing of their own. A federal judge is then set to weigh the injunction request at a hearing scheduled for May 27 in Los Angeles.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn a statement responding to Swift\u2019s opposition filing on Thursday (May 7), Flagg\u2019s attorney <strong>Jaymie Parkkinen <\/strong>said, \u201cWe read it. Defendants assert First Amendment protection for napkins and hairbrushes.
