{"id":10538,"date":"2026-05-02T11:01:44","date_gmt":"2026-05-02T11:01:44","guid":{"rendered":"https:\/\/usatrustedlawyers.com\/blog\/president-biden-issues-executive-order-on-promoting-competition-in-the-american-economy\/"},"modified":"2026-05-02T11:01:44","modified_gmt":"2026-05-02T11:01:44","slug":"president-biden-issues-executive-order-on-promoting-competition-in-the-american-economy","status":"publish","type":"post","link":"https:\/\/usatrustedlawyers.com\/blog\/president-biden-issues-executive-order-on-promoting-competition-in-the-american-economy\/","title":{"rendered":"President Biden Issues Executive Order on Promoting Competition in the American Economy"},"content":{"rendered":"\n<div id=\"contentSummaryCollapse\" style=\"--intro-p-height: 10.3125rem;\">\n<div class=\"inner-collapse\">\n<p>On July 9, 2021, President Joe Biden issued an <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/07\/09\/executive-order-on-promoting-competition-in-the-american-economy\/\" target=\"_blank\" rel=\"nofollow noopener\">Executive Order on Promoting Competition in the American Economy<\/a> (the \u201cOrder\u201d).<\/p>\n<p>The Order directs various federal agencies to combat anti-competitive conditions affecting the U.S. economy. The Order consists of 72 initiatives and recommendations across multiple sectors.\u00a0 Among other things, the Order targets fair labor initiatives, including non-competition provisions. Specifically, the Order \u201cencourages\u201d the Chair of the FTC to consider working with Commission to\u00a0 exercise the FTC\u2019s rule-making authority \u201cto curtail the unfair use of non-compete clauses and other clauses or agreements that may unfairly limit worker mobility.\u201d In its corresponding <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/07\/09\/fact-sheet-executive-order-on-promoting-competition-in-the-american-economy\/\" target=\"_blank\" rel=\"nofollow noopener\">press statement<\/a>, the White House states that the Order \u201c[e]ncourages the FTC to ban or limit non-compete agreements.\u201d The statement also notes that \u201c[t]ens of millions of Americans\u2014including those working in construction and retail\u2014are required to sign non-compete agreements as a condition of getting a job, which makes it harder for them to switch to better-paying options,\u201d and states that the Order\u2019s initiatives will, among other things, \u201c[m]ake it easier to change jobs and help raise wages by banning or limiting non-compete agreements.\u201d<\/p>\n<p>The Order does not impact current laws governing non-competition agreements, including those between employers and employees.
