\n\tStubHub will pay $10 million to resolve accusations by the Federal Trade Commission (FTC) that the ticket platform intentionally ignored new \u201cjunk fee\u201d rules by failing to properly disclose fees and charges.<\/p>\n

\n\tIn court filings on Thursday (April 9), the consumer watchdog said StubHub had \u201cunfairly and deceptively hidden and misrepresented the price of its tickets\u201d by tacking on fees and other charges later in a transaction \u2014 violating new federal rules imposed last May that require \u201call-in\u201d pricing on ticket platforms.<\/p>\n

\n\tThe case was sparked by StubHub\u2019s decision to delay for three days after the rules went into effect last spring \u2014 until after the NFL\u2019s annual release of tickets for the upcoming season. In a statement, FTC chairman Andrew Ferguson<\/strong> said the company chose to \u201cslow-walk compliance\u201d to make more money on the lucrative NFL release.<\/p>\n

\n\t\u201cExecutives decided that the competitive advantage from misleading consumers outweighed the risk of being caught,\u201d Ferguson said. \u201cStubHub thus allegedly seduced consumers away from honest competitors with low prices before jacking up the price with fees at the end of the transaction.\u201d<\/p>\n

\n\tThe $10 million will be used by StubHub to fund a settlement program in which certain fans can seek refunds for tickets purchased during the three-day window. In a statement, the company stressed that the case dealt with only a \u201climited number of transactions, spanning just three days.\u201d<\/p>\n

\n\t\u201cWe have long supported all-in pricing because it provides clarity for fans,\u201d a StubHub spokesman said. \u201cWhile we strongly disagree with the FTC\u2019s view of the case, we are addressing their concerns by refunding a portion of those buyers\u2019 fees.\u201d<\/p>\n

\n\tThe FTC\u2019s ban on \u201cjunk fees\u201d went into effect on May 12, barring ticket platforms and hotels from advertising anything other than the final price a consumer would pay at checkout. It was designed to combat \u201cdrip pricing\u201d \u2014 a practice where sites list deceptively low pricing, only to increase the total with hidden fees and surcharges as consumers near checkout.<\/p>\n

\n\tAccording to the FTC\u2019s lawsuit, internal StubHub documents show that the company knew the NFL rollout \u2014 set for just two days after the rule was to go into effect \u2014 was a \u201c99th percentile traffic event.\u201d So rather than complying immediately, the FTC says StubHub intentionally chose to \u201ccomply in phases over two days.\u201d<\/p>\n

\n\t\u201cDefendant recognized that it could secure a competitive advantage from its delayed fees rule compliance rollout,\u201d the agency writes.<\/p>\n
