U.S. Supreme Court justices expressed skepticism Monday of a challenge to a federal task force that recommends the preventative services, like cancer and diabetes screenings, that insurance companies must cover under the Affordable Care Act.
The high court is reviewing a federal appeals court ruling that the structure of the U.S. Preventive Services Task Force is unconstitutional because its 16 members are not selected by the president and confirmed by the Senate under the appointments clause. The case is the court’s latest brush with the constitutionality of President Barack Obama’s signature health law, which the justices have upheld several times since 2012.
