Staff Attorney’s Claims Against Court Supervisors Cleared to Proceed, State High Court Rules

A former staff attorney has been cleared to pursue claims against two state appellate court administrators accused of waging a bullying campaign against him, the Massachusetts Supreme Judicial Court unanimously ruled Thursday.

The state high court largely sided with Kenneth Bresler, a former trial and appellate prosecutor and legal educator, finding he put forth enough specific allegations to show that Lynn Muster, a staff attorney who became deputy chief staff attorney, and Mary Bowe, chief staff attorney, acted with “actual malice” in a coordinated effort that ended with his termination in December 2020.
