Pool Company Hit With Multimillion Verdict for Death of Toddler, Jury Decides

A jury in Missouri awarded a $25 million verdict against an inflatable pool company to parents whose daughter drowned in an above-ground pool but the final award was reduced based on fault percentage.

On Feb. 28, a jury determined Bestway USA was liable for the death of a 2-year-old girl who drowned in an above-ground pool. Kyle and Annaleah Justice brought defective design, failure to warn, and wrongful death claims against the defendant on behalf of Ellieanna Justice. The plaintiffs claimed their daughter used a nylon strap about 14.25 inches off the ground and vertical bars around the pool to climb into the water.
