Morgan & Morgan Chairs Wage-and-Hour Class Action Against Wayfair

This week, attorneys with Morgan & Morgan filed a wage-and-hour suit in Massachusetts federal court on behalf of employees of home decor and furniture company Wayfair. The class-action complaint alleges that the company requires its employees to perform compensable, off-the-clock tasks both before and after their shifts to avoid overtime compensation.

Takeaway: Wage-and-hour lawsuits are nothing new for employers, but other jurisdictions have seen an uptick in claims about performing overtime. Publix Super Markets is facing a barrage of wage-and-hour lawsuits in Florida federal courts. Morgan & Morgan is also backing the plaintiffs in the dozens of lawsuits that have been filed since April 4 on behalf of department managers and assistant department managers in various Florida stores. The suits contend that, in order to stay within targeted budgeted hours each week and avoid being flagged, the plaintiffs were pressured to perform off-the-clock work such as stocking goods, cleaning stores and assisting customers.
