A federal judge in Massachusetts this week granted Novi Footwear International Co.’s sanction request against another footwear company represented by Dechert. However, the court only granted fees pertaining to one of the discovery delays raised by plaintiff’s counsel, Ice Miller, resulting in an award reduced by nearly 60% of the original request.
In a July 15 opinion, U.S. District Chief Magistrate Judge Donald L. Cabell of the District of Massachusetts granted Novi’s request for sanctions relating to expenses incurred from its motion to compel discovery in its breach-of-contract suit against defendant Earth OpCo, and its private equity owner, Windsong Capital Management. The suit accused the Earth defendants of failing to pay for footwear products.
