Idaho Physician Sues for Constitutional Right to Medically Necessary Abortion

An Idaho doctor who specializes in maternal-fetal medicine has filed a lawsuit in U.S. District Court for the District of Idaho against state and local officials charged with enforcing the state’s ban on abortion, seeking a declaration that they are unconstitutional and unenforceable.

The physician, Stacy Seyb, practices within a specialty of obstetrics and gynecology that focuses on providing care to people with high-risk or complicated pregnancies. His complaint alleges that despite multiple abortion bans enacted in Idaho, abortion remains constitutionally protected when continuing a pregnancy would subject a pregnant person to serious medical risks or the pregnancy is medically futile.
