Federal Court Evaluates Constitutionality of School’s Transgender Policy Prohibiting Parental Notice

A Pennsylvania school district won partial dismissal of claims filed by a parent who alleged that a policy prohibiting parental notification when a student transitions to a different gender violated her right to direct care of her child.

Michelle Landerer, a parent of an eighth-grade student identified as O.G., filed suit in the U.S. District Court for the Middle District of Pennsylvania on April 3 against the Dover Area School District. Her suit took issue with a policy that prohibits parental notification when a student wants to socially transition to a different gender unless the student consents to parental notification. The complaint, Landerer v. Dover Area School District, alleged claims for due process, procedural due process, free exercise of religion, and violation of the Americans with Disabilities Act.
