Delta Dodges Massachusetts Personal Injury Suit Due to Jurisdiction Dispute

A remote-working Connecticut man injured after an in-flight beverage cart struck his knee cannot pursue his negligence suit against Delta Air Lines due to the state’s two-year statute of limitations, a federal judge held Tuesday.

U.S. District Judge Margaret R. Guzman for the District of Massachusetts said Connecticut’s two-year statute of limitations must apply to Michael Ricci’s lawsuit against Delta Air Lines because it has a more “dominant interest” than Massachusetts, where Ricci wanted the case to proceed. Ricci was injured on a Delta flight from Connecticut to Tennessee after a beverage cart broke free and struck his right knee in August 2021. He filed his complaint against the airline in November 2023, and Delta removed it to Massachusetts federal court in January 2024.
