Three of President Joe Biden’s U.S. district court judicial nominees in Maryland, New York and Pennsylvania have vowed to apply all binding Supreme Court precedent, including the 2022 Dobbs v. Jackson Women’s Health opinion that overturned Roe v. Wade.
“Answering a question about the correctness of a particular decision may tend to suggest that I would not fairly or impartially apply all Supreme Court precedent,” U.S. Magistrate Judge Adam B. Abelson, a nominee for a U.S. trial court judgeship in the District of Maryland, said in a written response to members of the Senate Judiciary Committee. “Because Roe v. Wade and Planned Parenthood v. Casey were overruled by Dobbs v. Jackson Women’s Health, I would not follow those cases, and I would instead faithfully apply the Dobbs decision in cases before me.”
