Second Fed Judge Mulls Sanctions for Prominent Phila. Attorney

A Philadelphia personal injury attorney is in hot water again as a federal judge in Pennsylvania looks to determine whether he should be sanctioned a second time this year after he was previously sanctioned for filing complaints that appeared to mislead the court regarding diversity jurisdiction.

A hearing in Madrid v. Walmart was held earlier this month, where U.S. District Judge Gerald J. Pappert of the Eastern District of Pennsylvania weighed whether to sanction Marc I. Simon, and co-counsel Harry B. Gosnear, both of Simon & Simon, for their behavior in connection with the suit, and for a practice in which paralegals were allowed to sign complaints for the leading attorney.
