A slip-and-fall suit against Target and a store manager is headed back to state court after a federal judge in Illinois determined the store manager was properly named in the suit, creating a lack of diversity of citizenship.
In a decision last week, U.S. District Judge Steven C. Seeger for the Northern District of Illinois remanded a negligence suit against Target and store manager Miriam Albrecht to state court after concluding Albrecht failed to carry her burden of showing fraudulent joinder. The court considered whether Albrecht contributed to Jenny Chan’s fall on a wet floor and whether the manager should be named in the case. These considerations were factored into determining whether there was diversity jurisdiction in the case, as Albrecht and Chan are Illinois residents.
