LVMH Moët Hennessy Louis Vuitton and TAG Heuer SA are facing a patent infringement complaint in Texas federal court by Watch Skins Corp., through their counsel at McKool Smith, over the alleged misappropriation of technology that allows people to display non-fungible tokens on smartwatches and buy and sell the blockchain-based assets securely.
Mauricio Uribe, a partner and chair of the data privacy and data protection practice group at Knobbe Martens in the Am Law 200 firm’s Seattle office, noted that typically, it takes about six or seven years after a patent is issued for the technology to have matured enough for enforcement litigation to thrive, even if the technology has lost popularity since its peak.
