Nearing the eve of the Aug. 1 enactment date for new Title IX rules, a federal court finally sided with the Biden administration as it awaits a decision from the U.S. Supreme Court on whether to side-step federal court injunctions blocking the revised rules.
U.S. District Judge Annemarie Carney Axon of the Northern District of Alabama is the first federal judge to issue an opinion rejecting a challenge to the final version of Title IX regulations, which offer more protections for LGBTQ+ students and sexual assault victims, among others. The plaintiff states Alabama, Georgia, Florida and South Carolina filed suit April 29, contending that the final rule should be vacated in its entirety because it violates the Administrative Procedure Act.
